An Act to make provision for the office of Deputy Superintendent of the Province of Wellington.
Preamble.
WHEREAS the Honorable William Fitzherbert, Superintendent of the Province of Wellington, has been elected Speaker of the House of Representatives, and under the circumstances it will be inconvenient for him to perform the duties of such Superintendent, and it is expedient to make provision for the performance of such duties by deputy:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Deputy Superintendent of Wellington Act, 1876.”
2 Provision for appointment of Deputy Superintendent of Wellington.
The Superintendent of the Province of Wellington may by warrant under his hand appoint such person as he may think fit, being an elector of such province, to be Deputy Superintendent of such province; and every person so appointed shall have and may do perform and exercise all the acts powers duties and authorities which lawfully might be done performed or executed by such Superintendent, as fully and effectually to all intents and purposes as if su6h Deputy Superintendent were Superintendent of the Province of Wellington, and notwithstanding that such Superintendent shall continue to reside within the province.
3 Vacancy in office of Deputy.
In case any Deputy Superintendent shall die or shall resign his office, or be removed therefrom by the Superintendent, the power hereby vested in the Superintendent may be exercised as often as occasion shall require.
4 Superintendent’s powers not affected.
Nothing herein contained shall be deemed to alter affect or abridge any power or authority by law vested in or given to the Superintendent; but no such power or authority shall be so exercised by the Superintendent unless the Deputy Superintendent shall refuse or neglect or be otherwise incapacitated to do any act or perform any duty he may lawfully be called upon to do or perform by virtue of this Act.
5 Duration of Act.
This Act, and any appointment made hereunder, shall respectively continue in force only until the end of the present Session of the General Assembly.
