An Act to vest certain Lands now Vested in the Governor in trust for certain Trustees.
Preamble.
WHEREAS by a grant from the Crown, bearing date the sixth day of July, one thousand eight hundred and seventy-five, the land described in the Schedule hereto was vested in James Macandrew, Esquire, as and being Superintendent of the Province of Otago, in trust for a commonage for the inhabitants of Tapanui: And whereas by section nine of “The Abolition of Provinces Act, 1875,”
all lands vested in the Superintendent of any province became and were vested in Her Majesty the Queen, for the same purposes and objects and subject to the same powers and conditions as those for which the said lands were held by the Superintendent of any such province: And whereas for the better carrying out of the trusts, purposes, and objects in and for which the land hereinbefore mentioned and hereinafter described in the Schedule hereto was granted, it is desirable to vest the said land in Trustees, and to provide for the management of the said land:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Tapanui Agricultural and Pastoral Exhibition Reserve Act, 1877.”
2 Lands vested in Trustees.
The lands described in the Schedule hereto shall be and are hereby absolutely vested in John Pry Kitching, David McKellar, James Rodgers, John Francis Herbert, and Francis William Mackenzie, all of the Tapanui District, in the Provincial District of Otago, settlers, under the name of “The Tapanui Agricultural and Pastoral Reserve Trust,”
and such Trust shall be a corporation, and have all the powers, rights, and privileges of incorporated bodies.
3 Land to be transferred.
The District Land Registrar of Otago shall, on the deposit with him of a copy of the Act, grant a certificate of title to the said land vested by this Act to the said “Tapanui Agricultural and Pastoral Reserve Trust.”
4 Trusts in which the lands are to be held.
The said land shall be held by the said Tapanui Agricultural and Pastoral Reserve Trust for the inhabitants of Tapanui as a site for the exhibition of stock, produce, and agricultural implements, and it shall not be lawful for the said Trust to sell or aliene the said land, nor to lease the same for any term of years longer than three years, and in every such lease it shall be expressly provided that at least once in every year the Trust shall permit the said land to be used for an exhibition of stock, produce, and agricultural implements.
5 Rents how appropriated.
All rents, issues, and profits received from the letting of the said land by the said Trust shall be expended in improving the said land, in providing proper accommodation for, and in granting premiums for and otherwise encouraging, the exhibition of stock, produce, and agricultural implements.
6 New Trustees how appointed.
If any member of the said Trust shall, by writing under his hand addressed to the Governor or to the said “Tapanui Agricultural and Pastoral Reserve Trust,”
resign or shall be absent from the Provincial District of Otago for twelve months, or shall be adjudged a bankrupt or insolvent within the meaning of any Bankrupt or Insolvency Act, or take the benefit of any Act for the relief of debtors, or shall be convicted of any felony, he shall cease to be a member of the said Trust, and the Governor may, in case of any such vacancy, or in case of the death of any member, appoint another or others in his place.
Schedule Description or Pastoral Association’s Ground at Tapanui
All that area in the Provincial District of Otago, in the Colony of New Zealand, being part of Section numbered sixty-two (62), Block thirteen (XIII.), Glenkenich Survey District, containing by admeasurement twelve (12) acres, more or less. Bounded on the North by the Tapanui Commonage, one thousand two hundred (1200) links; on the East by the Tapanui Commonage, one thousand (1000) links; on the South by Section numbered seventeen (17), known also as a school reserve, Section numbered sixteen (16), and Section numbered fifteen (15), all in Block thirteen (XIII.), Glenkenich Survey District, one thousand two hundred (1200) links; and on the West by the Tapanui Commonage, one thousand (1000) links: be all the aforesaid linkages more or less, as the same is delineated on the plan deposited in the District Survey Office, City of Dunedin.
