An Act to amend “The Saint Andrew’s Church (Wellington) Trustees Incorporation Act, 1873,”
and to grant further Powers to the Trustees incorporated by the said Act.
Preamble.
WHEREAS it is desirable to amend “The Saint Andrew’s Church (Wellington) Trustees Incorporation Act, 1873,”
and to empower the Trustees incorporated by the said Act to sell and dispose of the said parcel of land described in the second part of the First Schedule to the said Act, being the site of the said Saint Andrew’s Church, at Wellington, together with the buildings thereon, and to empower the said Trustees to invest the proceeds of the sale of the said site and buildings in the purchase of another site and the erection thereon of suitable buildings, to be appropriated for the purposes of the congregation of the Saint Andrew’s Church, Wellington:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Saint Andrew’s Church (Wellington) Trustees Act 1873 Amendment Act, 1877.”
2 Trustees may sell site.
It shall be lawful for the said Trustees to sell and dispose of the parcel of land secondly described in the First Schedule to the said Act, together with all buildings erected thereon, either by public auction or by private contract, in such manner and on such terms and conditions as the said Trustees for the time being shall think fit, and to convey the said premises when sold to the person or persons who shall become the purchaser or purchasers thereof.
3 Trustees to invest money arising from sale in purchase of other site.
The said Trustees shall, with all convenient speed after such sale, lay out and invest the moneys which shall arise therefrom in the acquisition of a parcel of land in or near the City of Wellington as an appropriate site for a place of public worship, and shall erect thereon a building or buildings for that purpose and for the purposes of a school, and, with any surplus after such acquisition and erection as aforesaid, shall erect a manse and such other buildings for the purposes of the said Saint Andrew’s Church congregation in Wellington as to the said Trustees shall seem expedient.
4 Trustees to stand possessed of purchased site on same trusts as present site is held. Trustees may sell new site and purchase another.
The said Trustees shall stand seized of the site to be so acquired as aforesaid, and of the buildings to be erected thereon as aforesaid, upon trust, to permit the same to be for ever appropriated and used as and for the congregation of the Saint Andrew’s Church in Wellington: Provided always that the said Trustees may at any time sell and dispose of the said site and buildings thereon if they invest the proceeds arising from such sale in the purchase of another site or sites and the erection of buildings thereon for public worship therein.
5 Interpretation clause.
The words “the said Act”
shall be taken to mean and include “The Saint Andrew’s Church (Wellington) Trustees Incorporation Act, 1873.”
The words “the said Trustees”
shall be taken to mean and include the Trustees for the time being appointed under the said Act, and this Act shall be read as part of the said Act, and all provisions in the Third Schedule of the said Act relating to sales of land shall apply to sales under this Act.
6 Proviso.
Provided always that no conveyance, lease, or other disposition of the said first-mentioned parcel of land, or of any site which may be substituted for the same, shall be executed by the said Trustees unless and until an absolute or conditional contract shall have been entered into by the said Trustees for the purchase of a site suitable for the purposes of the trust.
