An Act to declare the Validity of the Elections of certain Members of the House of Representatives.
Preamble.
WHEREAS doubts have been raised as to whether the several persons mentioned in the Schedule to this Act were duly elected at the last general election for the electoral districts set opposite their names respectively, and it is expedient that such doubts should be removed:
Be it therefore declared and enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Elections Validation Act, 1879.”
2 Names of persons set forth in Schedule deemed duly elected to the House of Representatives.
The several persons whose names are set forth in the Schedule to this Act were duly elected for the several electoral districts set opposite their names respectively, and they have not been and are not disqualified from sitting and voting in the House of Representatives accordingly.
3 Indemnity to such persons.
Every of the said persons shall be and is hereby indemnified, freed, and discharged from and against all penalties, forfeitures, incapacities, and disabilities whatsoever, if any, incurred or to be incurred by him by reason or in consequence of his having heretofore sat or voted, or his hereafter sitting and voting, as a member of the House of Representatives.
4 Application of Act.
This Act shall not apply to or affect any disqualification, penalty, forfeiture, incapacity, or disability which may arise or be incurred in consequence of any act, matter, or thing done, committed, or suffered, or which may exist after the passing of this Act.
5 Costs of action pending to be paid by persons indemnified.
It shall not be lawful for any defendant in any action, suit, bill of indictment, or information to avail himself of the provisions of this Act until he shall have tendered the payment of costs previously incurred in such action, suit, bill of indictment, or information.
