An Act to extend the Operation of “The Inspection of Machinery Act, 1882.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Inspection of Machinery Extension Act, 1883.”
2 Extension of inspection of machinery to faulty or defective machinery.
Where any machinery or any part thereof that now is, or from time to time hereafter may be, subject to the provisions of “The Inspection of Machinery Act, 1882,”
or any appliance or contrivance connected or used with such machinery or any part thereof, is or appears to any Inspector to be faulty or defective in any particular, or so dangerous as to be likely to cause loss of life or bodily injury to any person, he may give to the owner of such machinery a notice to that effect, and such notice may either require such owner—
(1.)
To wholly desist from working or using such machinery, or any appliance or contrivance used or connected therewith, from a period to be fixed in such notice, until certain repairs or alterations, to be stated in the notice, shall have been effected; or
(2.)
To have the arrangement of such machinery, appliance, or contrivance so altered, or the faulty or defective part thereof so placed or repaired, within a certain time to be stated in such notice as that the same shall not contravene “The Inspection of Machinery Act, 1882,”
or this Act.
3 Persons to comply with notice.
Penalty.
If any person to or upon whom any such notice shall have been served or delivered shall fail or neglect to comply with the terms of such notice, such person shall be liable to a penalty of not less than twenty pounds nor more than one hundred pounds.
4 Liability to penalty not to be a bar to civil or criminal proceedings.
The liability to or recovery of such penalty shall not be a bar to any action or proceeding by or at the suit of any person killed or injured by any such faulty or defective machinery in any case where such person or his personal representatives would have a right to recover compensation in respect of such death or injury.
Nor shall the owner of any machinery be exempted from any criminal liability which is or may be attached to him by reason of any such neglect or default as aforesaid.
5 Forms may be altered or modified; application of prior Act.
Any notice, certificate, form, or proceeding necessary for carrying into effect the provisions of this Act may be altered or modified as the case may require for the purposes of this Act and “The Inspection of Machinery Act, 1882”
; and, subject hereto, all the provisions of the last mentioned Act so far as applicable, shall extend and apply to this Act, and may be enforced accordingly.
