An Act to authorize the Temporary Closing of a Portion of a Public Street within the City of Wellington.
Preamble.
WHEREAS it is proposed shortly to hold an Exhibition of Manufactures and Industrial Products of New Zealand, at Wellington, under the control or direction of the Government of the colony, and, for the purposes of providing sufficient space for such Exhibition, it is desirable that a certain portion of a public street, as hereinafter defined, in the City of Wellington should be closed for public traffic during the continuance of such Exhibition, and that the soil of such street should be made available for the purposes of such Exhibition:
And whereas the owners of sections along the entire length of such street have expressed their assent to the closing thereof for the purposes aforesaid:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wellington Public Street-closing Act, 1885.”
2 Part of Ballance Street may be closed by order of City Council.
The City Council of Wellington may, by special order,—
(1.)
Declare the public traffic to be stopped on all that part of Ballance Street which lies between Stout Street on the north-west and a straight line projected from the north-western side of Maginnity Street to where it meets a point on the opposite side of Ballance Street, and may close such part of Ballance Street for such time as shall be named in such resolution, but not in any case for any time beyond the end of December next;
(2.)
Authorize the directors or persons having control or the management of the buildings to be used for an Exhibition as aforesaid to enter into occupation of such part of Ballance Street aforesaid, and to enclose the same with a fence, or to construct any building thereon, or cover the same over, and to dig up, remove, or alter in any way the soil thereof, and otherwise make use of such street and the soil thereof for the purpose of the Exhibition, as if the same were private land granted for the purpose.
3 Order may be made retrospective.
Any order for the object aforesaid shall be publicly notified within the city, and may be made to have a retrospective effect from the first day of June last prior to the making thereof, and shall be deemed to have authorized the closing of the aforesaid Ballance Street as on and from that date.
4 Fences, buildings, &c., to be removed.
The directors or persons aforesaid who, under the authority aforesaid, make use of the part of the street so closed, are hereby required, and shall be compelled, at their own proper costs and charges, at the closing of the Exhibition, to remove all fences, buildings, and other obstructions on the said street, and to restore the soil thereof and the level of the street in the same condition as when they entered into occupation thereof.
