An Act to authorise the Exchange of certain Reserves in the Town of Oamaru for other Pieces of Freehold Land more centrally situated in the same Town.
Preamble.
WHEREAS the Venerable Archdeacon Coleman, of Oamaru, Roman Catholic priest, is the owner in freehold of all those sections of land in the main street of the Borough of Oamaru, being sections numbered respectively three and four, block twelve, in Thames Street, and is desirous of giving the said section three in exchange for another section of land in the same town, being section eight, block forty-five, in Reed Street, and of giving said section four in exchange for section nine of said block forty-five, and is so desirous with the object of consolidating the property of the Roman Catholic community in that part of the said town, and preserving the privacy thereof:
And whereas the aforesaid section eight is a reserve set apart for purposes of public utility to the Town of Oamaru and its inhabitants, and said section nine is a reserve set apart for primary education, and is vested in the School Commissioners of the Provincial District of Otago and the Mayor, Councillors, and Burgesses of the Borough of Oamaru, and the said School Commissioners are willing to carry out the proposed exchange of land, as thereby they will respectively acquire more valuable sections of land, more centrally situated and better adapted for the purposes:
And whereas the Venerable Archdeacon Coleman has consented to pay all charges that may be incurred in and towards carrying out the proposed exchanges:
And whereas it is expedient that the proposed exchanges should be sanctioned by law:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Oamaru Municipal and Education Reserves Exchange Act, 1888.”
2 Municipal reserve may be exchanged.
On the execution of a conveyance or other instrument of transfer by the Venerable Archdeacon Coleman, of Oamaru, Roman Catholic priest, of all that parcel of land, being section number three, block twelve, Town of Oamaru, in favour of the Mayor, Councillors, and Burgesses of the Borough of Oamaru, to be held by the Mayor, Councillors, and Burgesses of the Borough of Oamaru for the same trusts and purposes as those for which the said section eight, block forty-live, is now held, the Mayor, Councillors, and Burgesses of the Borough of Oamaru, in exchange for the same, may execute a conveyance or other instrument of transfer of land in Reed Street, in the Town of Oamaru, being a municipal reserve, and being section number eight, block forty-live, in the said town, in favour of the aforesaid Venerable Archdeacon Coleman, or of such other persons as he may appoint; subject, however, that the aforesaid Archdeacon Coleman shall pay all the costs and charges incurred by all the parties to the proposed exchange in carrying out the same and giving effect thereto.
3 Education reserve in Reed Street may be exchanged for freehold section in Thames Street.
On the execution of a conveyance or other instrument of transfer by the said Venerable Archdeacon Coleman of all that parcel of land being section four of said block twelve, in Thames Street, in the Town of Oamaru, in favour of the School Commissioners of the Provincial District of Otago, to be held by the said Commissioners as an endowment for primary education under the provisions of “The Education Reserves Act, 1877,”
the aforesaid Commissioners, in exchange for the same, may execute a conveyance or other instrument of transfer of land in Reed Street, in the Town of Oamaru, being an education reserve, and numbered section nine of block forty-five in the said town, in favour of the aforesaid Venerable Archdeacon Coleman, or of such other persons as he may appoint; subject, however, that the aforesaid Archdeacon Coleman shall pay all the costs and charges incurred by all the parties to the proposed exchange in carrying out the same and giving effect thereto.
