An Act to revive and amend “The Thames Recreation Reserve Sale Act, 1884.”
Preamble
WHEREAS by “The Thames Recreation Reserve Sale Act, 1884”
(hereinafter referred to as “the said Act”
), the Council of the Borough of the Thames were authorised to sell a certain recreation reserve described in the Schedule of the said Act, and they have partly exercised the said power, but, in endeavouring to execute a title for some of the lands sold, have discovered that a block called the Whangorahi Block, containing eight acres and twenty-eight perches, as described in the Schedule to this Act, and intended to have been included in the Schedule to the said Act, was not so included; and whereas it is expedient to validate the aforesaid sales, and to enable the Council to give valid titles to the lands so sold, and also to enable the Council to dispose of the unsold portions of the above-mentioned reserve, and for all the aforesaid purposes it is necessary to revive the said Act and to extend the operation thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Thames Recreation Reserve Sale Revivor Act, 1891.”
2 Original Act revived.
“The Thames Recreation Reserve Sale Act, 1884,”
is hereby revived, and shall operate and shall be deemed to have operated continuously from the date of the passing thereof, and notwithstanding its expiry, as if section four thereof had never been enacted; and also as if the Schedule to this Act had been originally enacted and formed part of the Schedule to the said Act.
3 Sales of land in Schedule validated.
Every sale of any of the land described in the Schedule to this Act made under the supposed authority of the said Act is hereby validated, and a title relating back to the date of the sale thereof may be given for any of such land which has been sold as if there had been authority expressed in the said Act to sell such land.
4 Duration of Act.
The said Act and this Act shall be read together, and shall continue respectively in operation until repealed by Act of the General Assembly.
Schedule
All that parcel of land containing by admeasurement eight (8) acres and twenty-eight (28) perches, more or less, situate in Block VIII., Thames Survey District, called or known by the name of “Whangorahi,”
and numbered 4084. Bounded towards the north by Te Rapa Stream; towards the east and south by the Waiwha-kaurunga River; and towards the north-west by the Ohaene Block.
