An act to authorise the Sale of the Site of the Courthouse at Palmerston North and the Buildings thereon.
Preamble.
WHEREAS by Proclamation of the twenty-eighth day of July, one thousand eight hundred and seventy-one, the then Superintendent of the Province of Wellington did declare Town Section number seven, containing half an acre, and having a frontage of two chains to Main Street, in the present Borough of Palmerston North, to be reserved and set apart for the use of the Public Works Department of New Zealand, and such section is no longer required for such use:
And whereas by Proclamation of the twenty-first day of March, one thousand eight hundred and seventy-two, the aforesaid Superintendent did declare Town Section number four hundred and eighty-nine, containing one acre, and having a frontage of two chains to Main Street aforesaid, and a frontage of two chains to Church Street, in the same borough, to be reserved and set apart as a site for the erection of a Courthouse and other buildings connected with the administration of Justice; and, in furtherance of the said objects, the said acre has been subdivided longitudinally into two allotments, on one of which allotments containing one rood and twenty-four perches has been established a police-station, and on the other allotment containing two roods and sixteen perches, which adjoins Town Sections numbers six hundred and fifty-eight and six hundred and fifty-nine, a Courthouse and other erections have been built, but the site is found inconvenient for the purpose, as having too limited a frontage to Main Street:
And whereas it would be expedient to sell the allotment last-mentioned, with the Courthouse and other erections thereon, and to apply the proceeds in or towards the erection of another Courthouse on Town Section number seven:
And whereas both Town Sections numbers seven and four hundred and eighty-nine are vested in Her Majesty:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Palmerston North Courthouse Site Sale Act, 1892.”
2 Purpose of reservation changed.
Town Section number seven, in the Borough of Palmerston North, is hereby discharged from reservation for the use of the Public Works Department, and is hereby declared to be reserved and set apart as for a site for the erection of a Courthouse.
3 Governor may sell Courthouse site and buildings.
The Governor may authorise such person as he shall think fit to sell and dispose of, either together or in lots, by public auction or by public tender, that allotment containing two roods and sixteen perches in the Borough of Palmerston North being the portion of Town Section number four hundred and eighty-nine, having a frontage of one hundred and twenty links to Main Street, and adjoining Town Sections numbers six hundred and fifty-eight and six hundred and fifty-nine, together with the Courthouse and all buildings and other erections thereon; and the Governor may issue such title for the said land, and do and perform and execute all such deeds, matters, and things as may be necessary to give effect to the sale hereby authorised.
4 Proceeds to be paid into Public Account.
All moneys received from the sale of the said land and buildings shall, after deducting the expenses of the sale, be paid into the Public Account, and credited to Part I. of the Public Works Fund.
