An Act to authorise the Issue of Titles to certain Reserves in Westland to the Religious, Charitable, or Educational Bodies respectively occupying the same.
Preamble.
WHEREAS in that portion of the Town of Kumara which lies within the limits of an education reserve now vested in the School Commissioners for Westland, there were originally set apart reserves for various religious, charitable, and educational purposes, upon which reserves, or other lands exchanged for the said reserves, as the same are defined in the First and Second Schedules hereto, churches, schools, and a hospital have been built:
And whereas by “The Kumara Education Reserve Act, 1879,”
the aforesaid education reserve was brought subject to the mining law for the time being in force, and the aforesaid Commissioners were authorised to sell to the lessees of any sections in the said Town of Kumara the sections leased by them, but such power of sale was deemed not to extend to the lands set apart as aforesaid for the purposes hereinbefore mentioned, and it is expedient to permit the governing bodies of the several religious, charitable, and educational bodies at present holding the reserves in their respective occupation under residence-site licenses, issued under the aforesaid mining law, to acquire the fee-simple of the said reserves:
And whereas the lands described in the Third and Fourth Schedules hereto are vested in Her Majesty as a reserve for a Roman Catholic church, and as a reserve for a Wesleyan church respectively, and it is expedient to transfer and vest the same in manner hereinafter mentioned:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Westland Churches, Schools, and Hospital Vesting Act, 1892.”
2 School Commissioners of Westland may convey lands in First Schedule at Kumara for religious and charitable objects.
Subject as hereinafter mentioned, the School Commissioners for Westland are hereby authorised to convey in fee-simple to the officers following the lands herein mentioned, that is to say:—
(1.)
To the Church Property Trustees incorporated under ordinances of the Superintendent and Provincial Council of the late Province of Canterbury, intituled “The Church Property Trust Ordinance, Sess. II., No. 3,”
and “The Church Property Trust Amendment Ordinance, 1867,”
the land in the First Schedule first described, as a church site, in consideration of the sum of six pounds sterling:
(2.)
To the Presbyterian Church Property Trustees incorporated under “The Presbyterian Church Property Act, 1885,”
the land in the First Schedule secondly described, as a church site, in consideration of the sum of three pounds sterling:
(3.)
To the Right Reverend John Joseph Grimes, Doctor of Divinity, Roman Catholic Bishop of Christchurch, and his successors,—
(a.)
The land in the First Schedule thirdly described, as a site for a convent and convent school, in consideration of the sum of five pounds sterling; and
(b.)
The land in the First Schedule fourthly described, as a site for a church, presbytery, and boys’ school, in consideration of the sum of twenty-eight pounds sterling:
(4.)
To the corporation of the Kumara Hospital, the land in the First Schedule fifthly described, for the purposes of a hospital and grounds, in consideration of the sum of twenty-four pounds sterling.
3 School Commissioners may set apart land in Second Schedule as a public-school site.
The School Commissioners for Westland are hereby authorised to appropriate and set apart the lands described in the Second Schedule as a site for a public school.
4 Reserve at Pounamu, described in Third Schedule, vested in Roman Catholic Bishop.
The Governor may by warrant authorise the issue of a certificate of title to the Right Reverend John Joseph Grimes, Doctor of Divinity, Roman Catholic Bishop of Christchurch, and his successors, of the land described in the Third Schedule, as a site for a Roman Catholic church and schools.
5 Reserve at Kanieri, described in Fourth Schedule, vested in Trustees for Wesleyan Church.
The Governor may by warrant authorise the issue of a certificate of title to the Trustees for the time being in Westland of the Wesleyan Methodist Church in New Zealand, of the land described in the Fourth Schedule, as a site for a Wesleyan church.

FIRST SCHEDULE KUMARA BOROUGH
Church of England Reserve
ALL that piece or parcel of land containing 2 roods 30 perches, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District, and comprising Subdivisions Nos. 456, 455, 526, 525, 521, and parts of Subdivisions Nos. 537, 538, 539, 457, and 458, of the portion of the Town of Kumara, in the said reserve. Bounded towards the north-west by Third Street, 250 links; towards the north-east by Subdivision No. 523, 250 links; towards the south-east by other parts of said Subdivisions Nos. 537, 538, 539, 457, and 458, 254.9 links; and towards the south-west by Subdivisions Nos. 166, 165, 160, 159, 158, and 157, 300 links: be all the aforesaid linkages a little more or less, and which piece or parcel of land is delineated on the map showing the town sectional subdivision of the Kumara portion of said Reserve No. 128 (in red).
Presbyterian Church Reserve
All that piece or parcel of land containing 1 rood 20 perches, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District, and comprising Subdivisions Nos. 579, 580, and 581 of the portion of the Town of Kumara in the said reserve. Bounded towards the southeast by Third Street, 150 links; towards the south-west by Subdivision No. 578, 250 links; towards the north-west by Subdivisions Nos. 571, 572, and 573, 150 links; and towards the north-east by Subdivision No. 471, 250 links: be all the aforesaid linkages a little more or less, and which said piece or parcel of land is delineated on the map showing the town sectional subdivision of the Kumara portion of said Reserve No. 128 (in red).
Roman Catholic Convent School Reserve
All that piece or parcel of land containing 2 roods 20 perches, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District, and comprising Subdivisions Nos. 703, 704, 705, 706, and 707 of the portion of the Town of Kumara in the said reserve. Bounded towards the south-west by Tui Street, 250 links; towards the south-east by Third Street, 250 links; towards the north-cast by Subdivision No. 574, 250 links; and towards the north-west by Subdivision No. 702, 250 links: be all the aforesaid linkages a little more or less, and which said piece or parcel of laud is delineated on the map showing the town sectional subdivision of the Kumara portion of said Reserve No. 128 (in red).
Roman Catholic Church, Presbytery, and School Reserve
All that piece or parcel of land containing 3 acres 2 roods, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District, and comprising Subdivisions Nos. 614, 615, 616, 617, 618, 619, 620, 621, 622, 623,624, 625, 626, 627, 628, 629, 630, 631, 668, 669, 670, 671, 672, 673, 674, 675, 676, and 677, of the portion of the Town of Kumara in the said reserve. Bounded towards the north-east by Tui Street, 500 links; towards the south-east by Third Street, 700 links; towards the south-west by Town Belt South, 500 links; towards the north-west by Second Street, 700 links: be all the aforesaid linkages a little more or less, and which said piece or parcel of land is delineated on the map showing the town sectional subdivision of the Kumara portion of the said Reserve No. 128 (in red).
Hospital
All that piece or parcel of land containing 3 acres, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District. Bounded towards the south-west by Town Belt North; towards the north-west by the Greenstone Road, 750 links; towards the north by a gravel reserve; and towards the east by the Greenstone Road and lines along a creek: be all the aforesaid linkages a little more or less; and which said piece or parcel of land is delineated on the map showing the subdivisions of said Reserve No. 128 (in red).
SECOND SCHEDULE Kumara Public-school Site
ALL that piece or parcel of land containing 4 acres 2 roods 36 perches, more or less, being part of Education Endowment No. 128 (in red), Block XII., on the map of the Waimea Survey District. Bounded towards the south-west by Town Belt South, 450 links; towards the north-west by Fifth Street, 1050 links; towards the north-east by other part of said reserve, 450 links; and towards the south-east by other part of said reserve, 1050 links: be all the aforesaid linkages a little more or less, and which said piece or parcel of land is delineated on the map showing the subdivisions of said Reserve No. 128 (in red).
THIRD SCHEDULE Greenstone Roman Catholic Church Reserve
ALL that piece or parcel of land containing 2 acres and 16 perches, more or less, being Reserve No. 141 (in red) in the Township of Pounamu, Block IX., on the map of the Hohonu Survey District. Bounded towards the north by Whitcombe Street, 350 links; towards the east by Ross Street, 600 links; towards the south by Parry Street, 350 links; and towards the west by Franklin Street, 600 links: be all the aforesaid linkages a little more or less, and which above-described piece or parcel of land was set apart as a Reserve for Roman Catholic church and school purposes by His Excellency the Governor, the 22nd day of June, 1876, and gazetted in the New Zealand Gazelle No. 38 of the 29th June, 1876.
FOURTH SCHEDULE Kanieri Wesleyan Church Reserve
ALL that piece or parcel of land in the Westland Land District, situate in the Township of Kanieri, containing by admeasurement 35 perches, more or less, being Sections Nos. 28 and 29. Bounded towards the east by Christchurch Street; towards the south-west by Cobden’s Quay; towards the west by Section No. 27; and towards the north-east by the north-eastern boundary of the Township of Kanieri.
