An Act to authorise the Balance of the Taranaki Relief Fund being expended for certain Local Purposes.
Preamble.
WHEREAS during the Taranaki war of one thousand eight hundred and sixty-one a Committee, consisting of Harry Albert Atkinson, George Cutfield, Francis Ullathorne Gledhill, Richard Chilman, Josiah Flight, William Bayly, senior, Peter Elliott, all since deceased, and Messieurs Charles Brown, Thomas Good, Warwick Weston, William King Hulke, Thomas John Upjohn, and James Crowe Richmond, were appointed at a public meeting held on the fourth day of May, one thousand eight hundred and sixty-one, at New Plymouth, for the purpose of collecting funds for the distressed settlers in the Taranaki District who had suffered losses by reason of the war: And whereas all moneys collected by such Committee were distributed with the exception of a sum of one hundred and seventy pounds: And whereas the Treasurer of the fund, one Richard Chilman, who died more than fifteen years ago, paid into the Bank of New Zealand, on the sixth day of March, one thousand eight hundred and sixty-two, the said balance of one hundred and seventy pounds, to an account entitled “Treasurer, Taranaki Relief Committee,”
and such sum remained untouched till the eighth day of October, one thousand eight hundred and ninety-two, when it was taken out by the executors of the late Richard Chilman, who repaid themselves the sum of three pounds two shillings and threepence for some legal and other expenses they had incurred in connection therewith, and deposited the balance of one hundred and sixty-six pounds seventeen shillings and ninepence as a fixed deposit in their own names, in trust, for the twelve months ending the eighth day of October, one thousand eight hundred and ninety-three: And whereas it is desirable that the said sum of one hundred and sixty-six pounds seventeen shillings and ninepence, with the accrued interest thereon, should be applied for some purpose of public advantage, and for this purpose that it should be expended in equal proportions among the Board of Trustees for Public Recreation appointed under “The Taranaki Botanic Garden Act, 1876,”
in accordance with the objects of such Act, the Conservators of the State Forests who have the management of the portion of the Mount Egmont State Forest Reserve known as the North Egmont State Forest, and the Conservators of the State Forests who have the management of the portion of the Mount Egmont State Forest Reserve known as the East Egmont State Forest, to be by such Conservators respectively applied in or towards making Mount Egmont accessible to tourists and others by means of roadways or tracks; or, in the case of the East Egmont State Forest Conservators, by erecting a tourist mountain-house within the reserve for the benefit of those desirous of ascending Mount Egmont:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Taranaki Relief Fund Distribution Act, 1893.”
2 Interpretation.
In the construction of this Act “the said fund”
means the sum of one hundred and sixty-six pounds seventeen shillings and ninepence standing in the Bank of New Zealand, on fixed deposit, in the names of the Executors of Richard Chilman, deceased, late Treasurer of the Taranaki Relief Fund, together with interest thereon.
3 Fund to be paid to Board of Trustees for Public Recreation, and Conservators of North Egmont and East Egmont State Forest Reserve.
Upon the coming into operation of this Act the said fund shall be paid in three equal shares as follows:—
(1.)
To the Board of Trustees for Public Recreation appointed under “The Taranaki Botanic Garden Act, 1876”

(2.)
To the Conservators for the time being of State Forests who have the management of the portion of the Mount Egmont State Forest Reserve known as the North Egmont State Forest; and
(3.)
To the Conservators for the time being of State Forests who have the management of the portion of the Mount Egmont State Forest Reserve known as the East Egmont State Forest.
4 Receipt of secretary of different bodies to be sufficient discharge for moneys.
The receipt of the Secretary for the time being of the Board of Trustees for Public Recreation, and of the Conservators of the North Egmont Forest Reserve and of the East Egmont Forest Reserve respectively, shall be a sufficient discharge to the Executors of the late Richard Chilman for the proportion which the Board of Trustees for Public Recreation and such Conservators respectively are hereby entitled to receive.
5 Destination of moneys.
The moneys received by the Board of Trustees for Public Recreation shall be expended by them in carrying out the purposes of “The Taranaki Botanic Garden Act, 1876.”
The moneys received by the Conservators of the North Egmont State Forest shall be expended by them in or towards improving the road and tracks leading through the Forest Reserve to the summit of Mount Egmont.
The moneys received by the Conservators of the East Egmont State Forest shall be expended by them either in or towards erecting a tourist mountain-house for the accommodation of tourists and others ascending Mount Egmont, or in or towards improving the road and tracks leading through the reserve to the summit of Mount Egmont.
