An Act to provide for the Transfer of certain Real and Personal Property at St. Albans, comprising the St. Albans Library, and to make Provision for the future Management of the said Library.
Preamble.
WHEREAS by conveyance dated the eleventh day of September, one thousand eight hundred and seventy-four, registered in the District of Canterbury as “No. 42278,”
the land described in the Schedule hereto was conveyed by Thomas Gapes, therein described, to the Honourable John Thomas Peacock, William Hannibal Lane, Francis James Garrick, John Leaf Wilson, Ellington Mitchell, and Edmund Williams (hereinafter referred to as “the said Trustees”
), upon trust, inter alia, to erect a building thereon to be used as a Public Library for the use of the inhabitants of the St. Albans District who should become members of such library: And whereas the said land and buildings erected thereon by the said Trustees have fallen into disuse, and the said library has been closed: And whereas some of the said Trustees have died, or ceased to act in the matter of the said trust, and the continuing Trustees are not in a position to deal with the said land, buildings, or library in manner directed by the said recited deed: And whereas it is desirable to make provision as hereinafter set forth:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The St. Albans Public Library Transfer Act, 1893.”
2 Power of Trustees to convey land.
It shall be lawful for the Honourable John Thomas Peacock, William Hannibal Lane, and John Leaf Wilson, or other the continuing or surviving Trustees for the time being in whom the land and premises described in the Schedule hereto are vested, to convey the said land to Charles Robert Blakiston, of Christchurch, Esquire, and John Aldred, of St. Albans, Wesleyan Minister, or others, the Trustees for the time being of the Knightstown Library, also within the said St. Albans district, for an estate in fee-simple, upon the trusts hereinafter declared with respect thereto, and also to transfer to such Trustees all goods, chattels, books, papers, or other personal property hold or used in connection with the said premises, to be held upon such trusts so far as applicable, and for such purposes to execute and deliver all such conveyances, transfers, deeds, and instruments as may be necessary.
3 Conveyance of land deemed discharge of present Trustees.
Any such conveyance or transfer shall, when duly executed, and to the extent of the property dealt with by such instrument, effectually discharge the said John Thomas Peacock, William Hannibal Lane, and John Leaf Wilson, or other the continuing or surviving Trustees aforesaid, his and their estate and effects, of and from all liability whatsoever, under or in respect of their trusts as Trustees of the St. Albans Library, and the said trusts shall be and are hereby dissolved.
4 New trust defined.
The said land and premises shall be held by the Trustees of the Knightstown Library upon the same trusts as those on which the premises and property of the Knightstown Library are held, and upon the trusts following, namely:—
(1.)
Upon trust for the purpose of a public Mutual Improvement Association or public Mechanics’ Institute for the use of all persons resident in the district of St. Albans: Provided always that the power to appoint a new Trustee or new Trustees implied by law shall and may be exercised without obtaining the consent of the persons for the time being beneficially interested in the said trust estate.

With full power and authority from time to time to the said Trustees of the Knightstown Library to make, alter, and revoke any rules which to them may appear necessary for the management of the said Association or Institute and the trust estate generally, and for the admission of the public to the premises, or any of them, including the power to prescribe any fees or charges in respect of such admission, or for the use of any library, which, in the opinion of the said Trustees, may be required to meet the expenses of such management.
(3.)
And with power from time to time to apply any moneys that may come to the hands of the said Trustees of the Knightstown Library in or towards the purchase of books, newspapers, magazines, periodicals, or general literature, to be used for the purposes of the said Association or Institute.
(4.)
And with power for all or any of the purposes aforesaid to appoint a Committee, officers, and other persons to assist in the management of the said Association or Institute and premises, and the same or any of them to remove, dismiss, or discharge, and another or others to appoint, or by any such rule to be made as aforesaid to make provision for the re-election of any Committee, or other officers or persons, and for filling any vacancy in the office of committee-man.
Schedule
All that parcel of land, containing by admeasurement 20 perches more or less, being part of the Section No. 136 on the map of the Chief Surveyor of the Provincial District of Canterbury, setting out the rural lands in the Christchurch District thereof, commencing at a point on the south-eastern boundary of the said section a distance of 19 chains 8 links or thereabouts from the southern corner thereof, thence extending along the said south-eastern boundary a distance of 50 links, and back therefrom in a north-westerly direction a distance of 250 links, together with the buildings thereon, and all rights, ways, easements, members, and appurtenances to the same belonging and appertaining.
