An Act to amend “The Counties Act, 1886.”
Preamble.
WHEREAS several road districts in the colony have by special Acts of the General Assembly been abolished, and in their places counties have been substituted: And whereas doubts have been raised as to whether by such abolition of road districts and creation of new counties the road districts were, within the meaning of section fifty-seven of “The Counties Act, 1886,”
merged in the new counties: And it is expedient that such doubts should be set at rest:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Counties Act 1886 Amendment Act, 1895.”
2 Merging abolished road district.
Where any road district has heretofore been abolished by any Act of the General Assembly and a county constituted in substitution therefor, the provisions of section fifty-seven of “The Counties Act, 1886,”
shall be deemed to have applied on the date of the passing of such first-mentioned Act as if the road district had been merged in such county under the provisions of “The Counties Act, 1886.”
3 Boundaries of counties may be altered.
The boundaries of any two or more counties whose boundaries are contiguous may, on agreement come to between the Councils of such counties, be altered if approved by the Governor in Council, and, on and from the gazetting of an Order in Council defining the altered boundaries, the boundaries of such counties shall be deemed to be altered accordingly.
