An Act to empower the Mount Wellington Public Domain Board and Thomas Morrin to exchange certain Lands in the Mount Wellington Road Board District.
Preamble.
WHEREAS the piece of land described in the First Schedule hereto is part of a block of land, containing in area sixty-three acres three roods and seventeen perches, Crown lands set apart as a public reserve for recreation purposes, and is now under the control, management, and administration of the Mount Wellington Public Domain Board; and the piece of land described in the Second Schedule hereto is vested in one Thomas Morrin: And whereas it is desirable in the interest of the general public that the land in the said First Schedule should be vested in the said Thomas Morrin in fee-simple, and that the land described in the said Second Schedule should be conveyed to His Excellency the Governor of New Zealand for the same objects and purposes as land already set apart as a public reserve for recreation purposes, and under the management and administration of the Mount Wellington Public Domain Board:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Mount Wellington Public Domain Board and Thomas Morrin Exchange of Land Act, 1896.”
2 Exchange of land.
It shall be lawful for His Excellency the Governor of New Zealand, in the name and on behalf of Her Majesty, and be is hereby authorised, to issue a warrant (with the consent and approval of the Mount Wellington Public Domain Board) for a grant in fee-simple to the said Thomas Morrin, his executors, administrators, and assigns, of the land described in the said First Schedule, in exchange for a transfer by the said Thomas Morrin to His Excellency the Governor of New Zealand of the land described in the said Second Schedule, such land in the said Second Schedule to be set apart as part of a public reserve for recreation purposes, and placed under the control, management, and administration of the Mount Wellington Public Domain Board.
SCHEDULES
FIRST SCHEDULE
All that piece or parcel of land in the Auckland Land District, situated in the Parish of Waitemata, containing 3 acres 2 roods, more or less, being part of Lot 56 of Section 12, Suburbs of Auckland, Panmure, and being a portion of the Mount Wellington Recreation Reserve, which contains in all 63 acres 1 rood 17 perches, more or less. Bounded by a line commencing at the northernmost corner at peg XII. in centre of stone wall, and proceeding thence along a line bearing 110° 20’ 10", 603•9 links, to peg XI. (being the boundary-line between Mount Wellington Recreation Reserve and part of Lot 50); thence along a line bearing 121° 53’ 50", 798•2 links, to peg X. (being the boundary-line between Mount Wellington Recreation Reserve and Lot 14); thence along a line bearing 162° 46’ 40", 358 links, to peg XV. (being the boundary-line between Mount Wellington Recreation Reserve and Lot 13); thence northwesterly along a line bearing 300° 58", 1760• 2 links, to peg XVI., in centre of stone wall (being the boundary-line between part of Mount Wellington Recreation Reserve and other part of Mount Wellington Recreation Reserve); thence along a line bearing 66° 53’ 30", 173• 2 links, to peg XII., the starting-point (being the boundary-line between Mount Wellington Recreation Reserve and part of Lot 50).
SECOND SCHEDULE
All that piece or parcel of land in the Auckland Land District, situated in the Parish of Waitemata, being Lot 55, and part of Lot 56, of Section I., Small Farms, Panmure, containing 3 acres 2 roods 9 perches, more or less. Bounded by a line commencing at the northernmost corner at peg I. in centre of stone wall, and proceeding thence south-easterly along a line bearing 146° 26’ 10", 600 links, to peg II. (being the boundary-line between Lot 55 and Lot 54); thence along the north-west side of a road, 588 links, to peg III.; thence north-westerly along a line bearing 326° 26’ 30", 609•7 links, to peg IV., in centre of stone wall (being the boundary-line between part of Lot 56 and other part of Lot 56); thence north-easterly along a line bearing 55° 43’ 10", 588 links, to peg I., the starting-point (being the boundary-line between Lot 55 and part of Lot 56, and Lot 51a and Lot 53).
