An Act to give Greater Powers to the Inch-Clutha River and Road Board, and to provide for the Better Drainage of Inch-Clutha.
Preamble.
WHEREAS it is desirable to confer additional powers upon the Inch-Clutha River and Road Board:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Inch-Clutha Road, River, and Drainage Act, 1901.”
2 Interpretation.
In this Act, if not inconsistent with the context,—
“The said Board” means the Inch-Clutha River and Road Board:
“The district” means the Inch-Clutha River and Road District.
3 Inch-Clutha River and Road Board dissolved.
The Inch-Clutha River and Road Board is hereby dissolved, and shall henceforth cease to exist. All the powers, functions, duties, and authorities conferred upon the said Board shall and may henceforth be exercised and performed by the Inch-Clutha Road, River, and Drainage Board.
4 Powers conferred on Board.
All the powers conferred by the Drainage Act may be exercised and performed by the Inch-Clutha Road, River, and Drainage Board.
5 Members of Board.
The members of the said Board shall be the members of the Inch-Clutha Road, River, and Drainage Board for the time being.
6 Special drainage rate.
The Inch-Clutha Road, River, and Drainage Board for the annual period commencing the first day of November, one thousand nine hundred and one, and for each and every annual period there-after, may levy upon all rateable property in the district a special drainage rate.
7 Amount of rate.
The special drainage rate for each annual period shall not exceed two farthings in the pound on the annual rateable value.
8 Lands to be classified.
Notwithstanding anything to the contrary contained in “The Drainage Act, 1893,”
the lands of the district shall be classified under three classes only, as follows: First-, second-, and third-class land—that is to say, “first-class lands”
shall mean lands receiving most direct benefit; “second-class lands,”
those receiving less direct benefit; and “third-class lands,”
those receiving least direct benefit, from drainage-works.
9 Maximum rate that may be levied.
Notwithstanding anything hereinbefore contained, the whole amount of rates that can be levied shall not exceed six farthings in the pound on the annual rateable value on all properties in the district.
