An Act to constitute a Harbour Board for the Port of Waikokopu.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Waikokopu Harbour Board Act, 1902.”
2 Incorporation of “The Harbours Act, 1878,”
and the amendments thereof.
This Act shall be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
which Act and all Acts amending the same shall be incorporated with this Act.
3 Interpretation.
In this Act, if not inconsistent with the context,—
“Board” means the Harbour Board constituted under this Act:
“Port” means the Port of Waikokopu:
“The said Act” means “The Harbours Act, 1878,”
and all Acts amending the same.
4 Harbour of Waikokopu defined.
The Port of Waikokopu shall be the Port of Waikokopu as hereafter to be defined by a Warrant of the Governor, and shall thenceforth be known by such name, and the limits of the said port shall be the limits of the Port of Waikokopu as set forth in the said Warrant, or as may hereafter be defined under “The Harbours Act, 1878,”
or any Act amending the same.
5 Constitution of Board.
The Board shall consist of five members, to be appointed by the Governor.
The Governor shall appoint the day and place of the first meeting of the Board.
6 Harbour endowment.
The Governor in Council, in the name and on behalf of His Majesty, may issue a grant to the Board of the lands described in the Schedule hereto in trust for harbour purposes, and the Board after the issue of such grant shall have authority to reclaim the same from the sea.
All rents, issues, and profits arising or derived from the said lands shall be paid into and form part of the Harbour Fund Account.
Schedule Description of Foreshore.
All that area of 15 acres 3 roods 16 perches, more or less, in the Nuhaka Survey District, situated in the Land District of Hawke’s Bay, and bounded as follows: Commencing near the north-eastern corner of Block No. 1, Nuhaka Crown Grant District, at a point on the boundary due east from a peg marked No. II.; thence due east for a distance of 400 links; thence due north a distance of 1200 links; thence north-westerly a distance of about 290 links to the north-eastern corner of the portion of Block No. 3, containing 5 acres 3 roods, as proclaimed in the New Zealand Gazette No. 12, of 1902, page 332; thence generally in a south-westerly and then in a north-westerly direction by the boundary of the portion of Block No. 3 aforesaid to its south-westernmost corner; thence northerly by high-water mark along the left bank of the Waikokopu Creek a distance of 410 links; thence due west to high-water mark on the right bank of the aforesaid creek; thence southerly by high-water mark to the boundary between Blocks Nos. 2 and 3; thence generally in an easterly direction by the boundaries of Blocks Nos. 3 and 1 to the point of commencement.
