An Act to enable the Masterton Hospital Contributors (a Corporation constituted under “The Hospitals and Charitable Institutions Act, 1886”
) to sell certain Lands and Premises situate in the Small-farm Settlement of Masterton, with the Buildings thereon used as a Hospital.
Preamble.
WHEREAS it is deemed expedient to sell the lands and premises specified in the Schedule hereto, used as a hospital, and to apply the moneys arising from the sale thereof in acquiring another site, and erecting thereon buildings and premises requisite for a hospital:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Masterton Hospital Contributors Empowering Act, 1903”
2 Power to sell land.
It shall be lawful for the Masterton Hospital Contributors to sell the lands described in the Schedule hereto, with the buildings thereon, either by public auction or private contract, in one or more lots, and to convey the fee-simple in the same to the purchaser or respective purchasers thereof.
3 Application of the purchase money.
The moneys arising from such sale or sales shall be applied by the Masterton Hospital Contributors in or towards the purchase of lands in the Borough of Masterton or its vicinity to be selected, with the approval of the Public Health Department, as a site for a hospital, and in or towards erecting thereon the necessary and suitable buildings therefor:
Provided that this section shall not have effect until the consent of the electors of the Borough of Masterton has been obtained in the manner prescribed by “The Municipal Corporations Act, 1900,”
4 Lands when purchased to vest in Masterton Hospital Contributors.
The lands and site when so selected and acquired, and the fee-simple thereof, shall be held by, and the same shall be vested in, the Masterton Hospital Contributors for the purposes of the Masterton Hospital, upon the same trusts and with and subject to the same powers, restrictions, and provisions as the lands and premises authorised to be sold under the provisions of this Act are now subject.
Schedule
Firstly, all that area in the Wellington Land District, containing by admeasurement 2 acres 2 roods 13 perches, more or less, being part of Allotment No. 5 of Section No. 86, Block I., Otahoua Survey District (Masterton Small-farm Settlement), as delineated on Plan No. 114 deposited in the office of the District Land Registrar at Wellington, being the whole of the land comprised in Certificate of Title Register-book, Volume xx., folio 34. Secondly, all that area in the Wellington Land District, containing by admeasurement 3 roods, more or less, being Allotment No. 1 of Section No. 84, Block I., Otahoua Survey District (Masterton Small-farm Settlement), as delineated on Plan No. 656 deposited in the office of the District Land Registrar at Wellington, being the whole of the land comprised in Certificate of Title Register-book, Volume cxvii., folio 296.
