An Act to amend “The Hospitals and Charitable Institutions Act, 1885.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Stratford Hospital District Act, 1904”
; and it shall form part of and be read together with “The Hospitals and Charitable Institutions Act, 1885”
(herein-after referred to as “the principal Act”
).
2 Taranaki District altered. Stratford District constituted.
The First Schedule to the principal Act as amended by “The Hawera Hospital District Act, 1902,”
is hereby further amended by repealing the description of the “District of Taranaki,”
and substituting in lieu thereof the following:—
DISTRICT OF TARANAKI
All that area in the colony being the Counties of Clifton and Taranaki, and that portion of the County of Egmont situate to the west of the Arawhata Road, and including all boroughs therein.
DISTRICT OF STRATFORD
All that area in the colony being the County of Stratford, and including all boroughs therein.
3 Adjustment and apportionment of assets and liabilities between Boards.
The Taranaki Hospital and Charitable Aid Board and the Stratford Hospital and Charitable Aid Board may, on or before the thirty-first day of March, one thousand nine hundred and five, by an agreement executed under their respective common seals, make such an adjustment and apportionment of property, assets, liabilities, contracts, and engagements between the said Boards as they shall think fit, and such agreement shall be enforceable accordingly; but in default of any such agreement being come to on or before the said thirty-first day of March, one thousand nine hundred and five, it shall be lawful for the Controller and Auditor-General, or such other person as the Governor may appoint, to make the adjustment and apportionment, which shall be binding upon and be given immediate effect to by the said Boards; and in such case the costs and expenses of such adjustment and apportionment, which shall be fixed by the person making the same, shall be paid by the said Boards in equal shares.
4 Hospital-sites at Stratford to be vested in Stratford Board.
The lands described in the Schedule hereto, which have heretofore been reserved by the Crown for the purpose of hospital-sites, are hereby vested in the Stratford Hospital and Charitable Aid Board for an estate in fee-simple for the purpose aforesaid, subject to the provisions of the principal Act; and the District Land Registrar at New Plymouth shall, upon the delivery to him of a copy of this Act, issue to the said Board, without charge, a certificate of title under “The Land Transfer Act, 1885,”
for the said lands.
Schedule
All that area in the Taranaki Land District, containing by admeasurement 2 acres 1 rood, more or less, being Sections Nos. 871, 872, 873, 874, 875, 910, 911, 912, and 913, all in the Town of Stratford. Bounded towards the north-west by Celia Street, 220 links; thence towards the north-east by Miranda Street, 580 links; thence towards the south-east by sections numbered respectively 876 and 914, 440 links; thence towards the south-west by Portia Street, 464 links; thence again towards the north-west by Section No. 909, 220 links; and thence again towards the south-west by the said Section No. 909, 116 links: be all the aforesaid linkages a little more or less.
Also all that area in the Taranaki Land District, containing by admeasurement 3 acres, more or less, being Sections Nos. 878, 879, 880, 881, 882, 883, 916, 917, 918, 919, 920, and 921, all in the Town of Stratford. Bounded towards the north-west by sections numbered respectively 915 and 877, 440 links; towards the north-east by Miranda Street, 696 links; thence towards the south-east by Borneo Street, 440links; and thence towards the south-west by Portia Street, 696 links: be all the aforesaid linkages a little more or less.
