An Act to amend “The Public Works Amendment Act, 1904.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Works Amendment Act, 1905”
; and it shall form part of and be read together with “The Public Works Act, 1894.”
2 Section 5 of Act of 1904 amended.
(1.)
Section five of “The Public Works Amendment Act, 1904,”
is hereby amended by repealing the words “forty feet,”
and substituting in lieu thereof the words “sixty links.”
(2.)
Nothing in the said section five shall be deemed to authorise the registration of any transfer or conveyance on the sale of any land as mentioned in section two of “The Public Works Act, 1903,”
unless and until the Registrar is satisfied that the requirements of subsection two of the last-mentioned section have been complied with.
3 Unformed roads or streets.
On the petition of a majority of the owners owning not less than two-thirds of the frontage on any unformed road or street of not less than sixty-six feet in width, which had for five years or upwards prior to the year one thousand nine hundred been used as a public road or street, the local authority may form the same and apportion the cost thereof amongst the whole of the owners in proportion to the frontage held by them respectively, and may recover the amount so apportioned as if the same were a rate.
