An Act to constitute a Harbour Board for the Harbour of Havelock (Marlborough).
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Havelock Harbour Board Act, 1905.”
2 Act deemed special Act.
This Act shall be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
which Act and all Acts amending the same shall be incorporated with this Act.
3 Interpretation.
In this Act, if not inconsistent with the context,—
“Board” means the Harbour Board constituted under this Act:
“Harbour” means the port and harbour of Havelock:
“Harbour district” means the Havelock Harbour District:
“The said Act” means “The Harbours Act, 1878,”
and all Acts amending the same.
4 Harbour Board constituted.
A Harbour Board is hereby constituted under the said Act for the Harbour of Havelock, and such Board shall consist of five members, of whom three shall form a quorum; and such members shall be appointed and elected as follows:—
(a.)
Two members shall be appointed by the Governor.
(b.)
Two members shall be elected by the electors of the Town District of Havelock.
(c.)
One member shall be elected by the electors of that portion of the Kaituna Subdivision of the Pelorus Road District included in the harbour district.
5 Election of Board.
The first elective members of the Board shall be elected on a day to be fixed by the Governor, and shall hold office until the second Monday in February, one thousand nine hundred and eight, on which day their successors shall be elected; and thereafter an election of members shall be held on the second Monday in February in every alternate year.
6 Mode of election.
(1.)
The Governor may, by Order in Council gazetted, appoint a Returning Officer and polling-places for the purpose of the first election of members under this Act, and a day for such election, and may make such further provision for the same purpose as he deems necessary.
(2.)
Elections for membership of the Board shall be conducted under the provisions of “The Local Elections Act, 1904.”
7 Endowment.
The Board is hereby endowed with—
(a.)
The foreshore of the harbour inside a right line drawn from Watanihi (Black Point) to the northernmost corner of Section 12, Block VI., Linkwater Survey District; excepting therefrom the foreshore of the Pelorus River above a right line drawn from the southernmost end of Section 11, Block VII., to the northernmost corner of Section 2, Block XI., Wakamarina Survey District:
Provided that such endowment shall not prejudicially affect the rights of any person in connection with the foreshore extending from the southernmost part of Section 11, Block XL, Wakamarina Survey District, to Watanihi:
(b.)
The mud-flats within the harbour, as described in the First Schedule hereto:
(c.)
All pilotage and port charges in the Harbour of Havelock.
8 Power to borrow.
(1.)
The Board shall have power from time to time to borrow, on the security of its endowments, subject to the provisions of the said Act, any sum not exceeding one thousand pounds for the construction or completion of harbour-works in or towards the improvement of the said harbour.
(2.)
Such moneys may be raised in the manner prescribed by “The Local Bodies’ Loans Act, 1901”
; and the provisions of that Act shall apply as if the Board were a local authority and the said works were public works within the meaning of Part I. of that Act:
Provided that at any poll taken on a proposal to raise any such money every elector of the harbour district shall be entitled to one vote and no more.
9 Harbour improvement rate.
The Board may make and levy a harbour improvement rate not exceeding one farthing in the pound in the year upon the capital value of all rateable property in the harbour district:
Provided that such rate shall not be made except with the previous consent of the ratepayers in the harbour district, expressed in the manner provided by “The Local Elections Act, 1904.”
10 Boundaries of Havelock Harbour District.
The Havelock Harbour District shall comprise all the area described in the Second Schedule hereto.
SCHEDULES
FIRST SCHEDULE
The mud-flats at the head of the Kaituna and Pelorus Bays, including Block A, Havelock.
SECOND SCHEDULE Harbour District
All that area in the Marlborough Land District bounded towards the north-east by a right line from Black Point (Watanihi), on the western shore of Pelorus Sound, to a point on the south-eastern shore of Pelorus Sound in line with the north-eastern boundary-line of Section No. 12, Block VI., Linkwater Survey District; thence towards the south-east generally by the south-eastern shore of Pelorus Sound to a point in line with the southern boundary-line of Section No. 6, Block V., Linkwater Survey District; thence towards the east generally by a right line across the Mahakipawa Arm of Pelorus Sound to the northernmost corner of Section No. 3, Block IX., Link water Survey District; thence by the last-mentioned section and Section No. 12 of the said Block IX. to the eastern boundary-line of Section No. 3, Block XII., Wakamarina Survey District; thence by the eastern boundary-line of the said Section No. 3 to its south-eastern corner; thence by a right line to Trig. Station Y in Block XIII., Linkwater Survey District; thence by the summit of the main range over Trig. Station MM, Mount Cullen, to Trig. Station GG in Block I., Cloudy Bay Survey District; thence towards the south generally by a right line running westerly to the nearest source of Rocky Creek; thence by the said Rocky Creek to the Kaituna River; thence by the said Kaituna River to its confluence with the Atuhaua Creek; thence by the said Atuhaua Creek to a point in line with the western boundary-line of Section No. 14, Block III., Onamalutu Survey District; thence towards the west generally by a right line to the southernmost corner of the said Section No. 14; thence by the western boundary-line of the last-mentioned section to its northernmost corner; thence across a public road, and by the western boundary-line of Section No. 1, Block XV., Wakamarina Survey District, to its north-western corner; thence by the forest reserve in Blocks XV., XI., and XII., Wakamarina Survey District, as described in the New Zealand Gazette No. 61, of the 28th July, 1881, to the southern boundary-line of Section No. 5, Block XII. aforesaid; thence by the southern boundary-line of the said Section No. 5 to the southernmost corner of Section No. 8, Block XI., Wakamarina Survey District; thence by the last-mentioned section and Section No. 2, Block XI. aforesaid, to the northernmost corner of the said Section No. 2; thence by a right line across the mouth of the south branch of the Pelorus River to the southernmost point of Section No. 11, Block VII., Wakamarina Survey District; thence by the western shore of Pelorus Sound to the northernmost corner of Section No. 10, Block VII. aforesaid; and thence towards the north generally by the northern shore of Pelorus Sound to Black Point, the place of commencement.
