An Act to amend “The Hutt Railway and Road Improvement Act, 1903.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Hutt Railway and Road Improvement Act, 1905”
; and it shall form part of and be read together with “The Hutt Railway and Road Improvement Act, 1903”
(hereinafter referred to as “the principal Act”
).
2 Power to raise money for works authorised by principal Act.
(1.)
For the purpose of providing funds for the works authorised by the principal Act the Colonial Treasurer is hereby empowered from time to time to raise, on the security of and charged upon the public revenues of New Zealand, such sums of money not exceeding in the whole the sum of two hundred thousand pounds, and not exceeding in any financial year ending the thirty-first day of March the sum of seventy-five thousand pounds:
Provided that to the extent to which the full sum of seventy-five thousand pounds is not raised in any one financial year, to the same extent the sums raised in any subsequent financial year may exceed seventy-five thousand pounds.
(2.)
The sums so raised shall bear interest at such rate, not exceeding four pounds ten shillings per centum per annum, as the Colonial Treasurer from time to time prescribes, and shall be raised under and subject to the provisions of “The New Zealand Loans Act, 1904.”
(3.)
The total amount authorised by this Act to be raised shall include the moneys already raised under the principal Act, and all moneys raised under that Act shall be deemed to have been raised under this Act.
Repeal.
(4.)
Section five of the principal Act is hereby repealed.
3 No electricity to be carried over Hutt Road or Railway. Exception.
No electrical power or current for use for traction purposes, unless owned and controlled by the State, shall be transmitted or carried on, under, or over any part of the road or railway authorised under the principal Act, except within a distance of fifteen chains from the present northern boundary-line of the City of Wellington.
