An Act to enable the Mayor, Councillors, and Burgesses of the Borough of Port Chalmers and the Otago Dock Trust to exchange certain Lands in the Borough of Port Chalmers.
Preamble.
WHEREAS the parcels of land specified in the First Schedule hereto comprise portions of the Town Belt of the Borough of Port Chalmers which are vested in the Mayor, Councillors, and Burgesses of the Borough of Port Chalmers (hereinafter called “the Corporation”
) in trust for purposes of the public recreation of the Town of Port Chalmers and its inhabitants, and the parcel of land specified in the Second and Third Schedules hereto is vested in the Otago Dock Trust (hereinafter called “the Trust”
) as an endowment for the graving-dock at Port Chalmers: And whereas an agreement for the exchange of the said lands for the purposes hereinafter specified has been made between the Corporation and the Trust:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Borough of Port Chalmers and Otago Dock Trust Exchange of Land Act, 1906.”
2 Power to Otago Dock Trust to exchange lands.
It shall be lawful for the Trust, and the Trust is hereby empowered, to transfer to the Corporation, in exchange for the piece of land specified in the First Schedule hereto, all its estate and interest in all that piece of land situated in the said Borough of Port Chalmers described in the Second Schedule hereto, for the purposes of reclamation and public recreation, and all that piece of land situated in the said borough described in the Third Schedule hereto, for the purposes of a public street.
3 Power to Port Chalmers Corporation to exchange lands.
It shall be lawful for the Corporation, and the Corporation is hereby empowered, to transfer to the Trust, in exchange for the said lands specified in the Second and Third Schedules hereto, all its estate and interest in all that piece of land described in the First Schedule hereto, to be held by the Trust for the same trusts and purposes as those upon which the land described in the said Second and Third Schedules is now held by the Trust.
SCHEDULES
FIRST SCHEDULE
All those parcels of land situated in the Borough of Port Chalmers, containing 3 roods 20 perches, more or less, comprising all those portions of the Town Belt of the said town lying between Macandrew Road and the boundary of the endowment vested in the Trust by “The Otago Dock Act, 1883,”
and “The Otago Dock Act 1883 Amendment Act, 1885”
: commencing at a point 106 links from the north-east corner of Section 412 of the said town in a line at a bearing of 68° 31′, and terminating at a point on the eastern boundary of the said Macandrew Road, distant 2958·7 links from the commencing-point.
SECOND SCHEDULE
All that parcel of land situated in the Borough of Port Chalmers, containing 5 acres 1 rood 29 perches, more or less, being part of the land known as the Mussel Bay Endowment: bounded towards the east and south-east by the Port Chalmers Domain and Wickliffe Terrace, 1420 links; towards the south-west by other part of the said endowment, 775·6 links; towards the north-west by other part of the said endowment, 843·5 links.
THIRD SCHEDULE
All that parcel of land situated in the Borough of Port Chalmers, containing 2 roods 18 perches, more or less, being other part of the said endowment: bounded towards the north-east by Wickliffe Terrace and the Port Chalmers Domain, 630 links; towards the south-east by part of the land described in the Second Schedule hereto, 100 links; towards the south-west by other part of the said endowment, 600 links; and towards the north-west by land taken for railway purposes, 100·7 links.
