An Act to constitute the Eltham County.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Eltham County Act, 1906.”
2 Constitution of Eltham County.
(1.)
The Eltham County is hereby constituted, and shall comprise that portion of the Hawera County particularly described in the First Schedule hereto.
(2.)
The boundaries of the Hawera County so altered are particularly described in the Second Schedule hereto.
3 Jurisdiction of County Council.
From and after the coming into operation of this Act, and during the existence of the county so constituted, no local authority other than the Eltham County Council shall, within the limits of the said county, exercise any jurisdiction or authority over any roads or over or in relation to any matter or thing in respect of which jurisdiction is conferred upon a County Council under the provisions of “The Counties Act, 1886,”
or any amendments thereof, or otherwise:
Provided that nothing herein shall limit the power of the Governor at any time to proclaim a town district in the said county.
4 Merger of portion of Waimate Road District.
(1.)
So much of the Waimate Road District as is included within the boundaries of the county constituted by this Act is hereby declared to be merged in that county.
(2.)
The remaining portion of the said road district shall be deemed to be a road district whose boundaries have been altered by the formation of a new district under “The Road Boards Act, 1882.”
SCHEDULES
FIRST SCHEDULE Boundaries of the Eltham County
All that area in the Land District of Taranaki, bounded by a line commencing at the summit of Mount Egmont, and proceeding thence southerly along a straight line to a point in the middle of the north end of the Auroa Road at its junction with the Forest Reserve boundary; thence southerly along the middle of the said road to its junction with the southern boundary of Block IX, Kaupokonui Survey District; thence easterly along the southern boundaries of Blocks X and XI, Kaupokonui Survey District, to a point in the middle of the Palmer Road and in a direct line with the said southern boundaries of Blocks X and XI, Kaupokonui Survey District; thence southerly by the middle of the Palmer Road to a point in the middle of the Skeet Road at its junction with the Palmer Road; thence easterly along the middle of the Skeet Road to a point in the middle of the Waingongoro River where it is crossed by the Skeet Road; thence westerly and southerly by the middle of that river to a point opposite the middle of the Onewhaia Road; thence south-easterly by the middle of that road and by part of the western boundary and by the south-western boundary of Section 69, Block I, Hawera Survey District, and its continuation in a direct line to the middle of the Mountain Road; thence northerly by the middle of the Mountain Road to a point opposite the southern boundary of Section 12, Block II, Hawera Survey District; thence easterly by the southern boundary of the said Section 12 to the western boundary of Section 20, Block II, Hawera Survey District; thence southerly by the western boundary and easterly by the southern boundary of said Section 20, and by the continuation of the said southern boundary to the middle of the Fraser Road; thence north-easterly by the middle of the Fraser Road to the middle of the Tiromoana Road; thence easterly and northerly by the middle of the Tiromoana Road to a point in line with the south boundary of Subdivision 9, Section 4, of said Block II; thence northeasterly by that boundary and part of the north-western boundary of Block III, Hawera Survey District, to the easternmost corner or angle of said Block II, Hawera Survey District; thence north-westerly along the north-east boundary of said Block II, Hawera Survey District, to the middle of the Ararata Stream; thence north-easterly by the middle of that stream to the middle of the Makino Road; thence easterly along the middle of the Makino Road to a point in line with the western boundary of Section No. 1, Block XVI, Ngaire Survey District; thence northerly by a right line to the south-western corner of the last-mentioned section; thence by the western boundary of that section to the Tutaeariari No. 1 Block; thence south-easterly and north-easterly by the southwestern and south-eastern boundaries of the said Tutaeariari No. 1 Block respectively to the Aorere Road; thence by a right line across that road, and by the south-eastern boundary of Ariari No. 1 Block and the production of the said southeastern boundary to the middle of the Patea River; thence south-easterly by a line along the middle of the said Patea River to a point in line with the northern boundary of Section No. 4, Block XIII, Omona Survey District; thence easterly by a right line to the north-western corner of the last-mentioned section; thence by the northern boundary of the said Section No. 4 and the northern boundaries of Sections Nos. 2 and 4, Block XIV, Omona Survey District, and the production of the northern boundary of the last-mentioned section to the middle of the Whenuakura Valley Road; thence by a line along the middle of the Whenuakura Valley Road to its junction with the Epero Road; thence by a line along the middle of the Epero Road to the western boundary of Section No. 3, Block XVI, Omona Survey District; thence southerly by the western boundary of the last-mentioned section to the Lower Moeawatea Road, and by the production of the said western boundary of Section No. 3 to the middle of the said Lower Moeawatea Road; thence north-easterly along the middle of the last-mentioned road to a point in the middle of the Rawhitiroa Road at its junction with the aforesaid Lower Moeawatea Road; thence southeasterly along the said Rawhitiroa Road to a point in the middle of the Koane Road at its junction with the said Rawhitiroa Road; thence northerly generally along the middle of the Koane Road to Section No. 17, Block XII, Omona Survey District; thence by the north-eastern boundary-line of that section to the Moeawatea Road; thence by the Moeawatea Road to a point in a line with the northern boundary of Section No. 3, Block VIII, Omona Survey District; thence by a right line to the north-eastern corner of the last-mentioned section; thence by the northern boundaries of Sections Nos. 3, 4, and 1, Block VIII aforesaid, a right line across the Karewa Road, and by the northern boundary-lines of Sections Nos. 21, 4, and 1, Block VII, Omona Survey District, and a continuation in a westerly direction of the northern boundary of the last-mentioned section to its junction with the south-eastern boundary of the New Plymouth Harbour Board Rating District as described in the Second Schedule to “The New Plymouth Harbour Board Ordinance 1875 Amendment Act, 1877”
; thence south-westerly by the said south-eastern boundary-line to its intersection with the production in an easterly direction of the southern boundary-line of Block VIII, Ngaire Survey District; thence westerly by a right line to the south-eastern corner of the said Block VIII; thence by the southern boundary of the said Block VIII to Trig. Station B, Pahui; thence westerly by a right line to the south-eastern corner of Section 48, Block VI, Ngaire Survey District; thence by the southern boundaries of Blocks VI and V, Ngaire Survey District, to the middle of the Waingongoro River; thence in a north-westerly direction by the middle of the Waingongoro River to the middle of the Finnerty Road; thence westerly by the middle of the Finnerty Road to the middle of the Hastings Road; thence south-easterly by the middle of the Hastings Road to a point opposite the northern boundary of Section 32, Block VIII, Kaupokonui Survey District; thence westerly to and along the said boundary to the western boundary of said Section 32; thence southerly along the said western boundary to the northern boundary of Section 31, Block VIII, Kaupokonui Survey District; thence westerly by the said northern boundary and its continuation in a direct line to and across the Duthie Road to the north-eastern boundary of Section 29, Block VIII, Kaupokonui Survey District; thence by the north-eastern and northern boundaries of said Section 29 to the middle of the Palmer Road; thence southerly along the middle of that road to the northern boundary of Block XI, Kaupokonui Survey District; thence westerly by the northern boundary of said Block XI, and southerly by the western boundary of that block to the north-eastern corner of Block X, Kaupokonui Survey District; thence westerly along the northern boundary of said Block X to the south-eastern corner of Section 1, Block VI, Kaupokonui Survey District; thence northerly along the eastern boundary of Section 1 to the Opunake Road; thence westerly along the south side of said Opunake Road to a point in line with the eastern boundary of Section 16, Block VI, Kaupokonui Survey District; thence northerly across the Opunake Road and along the east boundaries of Sections 16, 13, and 11, Block VI, Kaupokonui Survey District, to the north-eastern corner of the last-mentioned section; and thence by a right line to the summit of Mount Egmont at the place of commencement: excepting from the above-described area the Borough of Eltham.
SECOND SCHEDULE
All that area in the Taranaki Land District, bounded towards the north generally by the Eltham County as described in the First Schedule hereto; towards the south-east by the Patea County as described in the New Zealand Gazette No. 85, of the 23rd October, 1902; towards the south-west by the sea; and towards the west generally by the Egmont County as described in the Schedule to “The Egmont County Act, 1901”
: excepting from the above-described area the Borough of Hawera.
