An Act to amend the Hauraki Plains Act. 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Hauraki Plains Amendment Act, 1912, and shall form part of and be read together with the Hauraki Plains Act, 1908 (hereinafter referred to as the principal Act).
2 Section 4 of principal Act amended.
(1.)
Section four of the principal Act is hereby amended by omitting from subsection one, as amended by section two of the Hauraki Plains Amendment Act, 1911, the words “one hundred and twenty thousand pounds,”
and substituting the words “one hundred and forty-five thousand pounds.”
Repeal.
(2.)
Section two of the Hauraki Plains Amendment Act, 1911, is hereby repealed.
3 Description of land subject to drainage rates.
(1.)
For the purposes of the rate to be made and levied in pursuance of section four of the Hauraki Plains Amendment Act, 1911, the land subject to the operations of the principal Act shall be deemed to be the land described in the Schedule hereto, whether such land is Crown land or not, and shall also include all land hereafter acquired by the Governor in pursuance of section nine of the principal Act, and such other land as the Governor from time to time by Order in Council declares to be so subject to the operations of the said Act.
(2.)
The said land may be reclassified from time to time in the manner specified in the said section four, and the rates levied thereon may from time to time be adjusted in accordance with such reclassification.
4 Lands in Schedule, how rated.
(1.)
So long as a rate is levied by the Minister of Lands under the authority of the Hauraki Plains Amendment Act, 1911, or until Parliament otherwise directs, the lands liable to that rate, as described in the Schedule to the principal Act, shall not be liable to be rated in respect of any general rate made and levied by the Council of any county within which any part of such lands is situate.
(2.)
The said lands shall nevertheless be liable to be rated in respect of rates made and levied under the authority of and for the purposes of the Hospitals and Charitable Institutions Act, 1909, by the County Council of any county within which any part of such lands is situate.
(3.)
Every owner and occupier of any of the said lands shall, notwithstanding his exemption from general county rates, be deemed to be a ratepayer of the county within which his lands are situate, and his name shall be entered upon the ratepayers roll of such county as if his lands were not so exempted.
Schedule
All that area in the Auckland Land District bounded by a line along high-water mark of the Firth of Thames from the mouth of the Waitakaruru Stream to the westernmost corner of Orongo Block; thence along the south-western boundary of that block, and the western boundaries of Wharetoa, Pirau, Wharemaoho, Ngataipua East, Te Awamawhanga, Kaipapaka, Oparia, Rautawhiri, Haereawatea, Raupoiti, Awakahawai, Ngaruerue, and Kairere Blocks, and the south-western boundaries of Tahanui, Kauri, Motumotuahi, Putanui, Urumatonga, Manuka, and Kurunui Blocks to the northernmost corner of Wairau Block; thence along the north-eastern and south-eastern boundaries of the last-mentioned block and the south-eastern boundaries of Kaikahu No. 4 and Awaiti No. 2c Blocks to the Tahanui Block; thence along the northern boundary of the Tahanui Block to its north-western corner; thence along the western and part of the southern boundaries of that block to the road at the north-eastern corner of Section No. 11, Block XI, Waihou Survey District; thence along the north-western, south-western, and southern boundaries of that section, and the southern boundaries of Sections Nos. 10, 9, 8, and 7, across a road, and along the southern boundary of Section No. 6, Block XI aforesaid, to Ahipukahu No. 3 Block; thence along the western and southern boundaries of that block to Section No. 9, Block XII, Waihou Survey District; thence along the western boundary of that section and the western boundary of Section No. 1 to the south-eastern corner of Awaiti No. 2b Block; thence along the southern boundary of that block to its south-western corner; thence along a right line to a point on the Awaiti Stream distant about 40 chains south of the intersection of that stream by the north-western boundary of the Awaiti 1b No. 2 Block; thence along the said Awaiti Stream to the north-western boundary of Awaiti No. 1c Block; thence along the said north-western boundary of that block to the Waihou River; thence along the left bank of the Waihou River to the northernmost corner of Awaiti 1h No. 2 Block; thence along the north-western and south-western boundaries of that block, the northern and south-western boundaries of Awaiti 1e No. 1 Block, and the south-western and south-eastern boundaries of Awaiti 1e No. 2 Block to the Waihou River; thence along the left bank of that river to the Thames Borough Endowment; thence along the north-western boundary of that endowment to Awaiti No. 5 Block; thence along the north-eastern and north-western boundaries of that block, the north-western boundary of Koromatua No. 2 Block, and that boundary produced to the left bank of the Waitoa Stream; thence along the left bank of that stream to the Whakahoro Road; thence along the southern side of that road to the Piako River; thence across that river and along its left bank to the south-eastern corner of Willis’s Grant, in Block IX, Waitoa Survey District; thence along the southern boundary of that grant to the Waitakaruru-Tahuna-Morrinsville Road; thence along the eastern side of that road to its junction with the road in Waitakaruru Block which runs north-easterly to near the mouth of the Waitakaruru Stream; thence along the north-western side of the last-mentioned road to the Waitakaruru Stream; and thence along the said Waitakaruru Stream to the sea, the place of commencement: as the same is delineated on the plan marked L. 1911/117, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged green.
