An Act to constitute the Kaitaia Land Drainage District.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Kaitaia Land Drainage Act, 1913.
2 Kaitaia Land Drainage District constituted.
The area described in the Schedule hereto is hereby constituted a drainage district, to be called the Kaitaia Land Drainage District, and, except as hereinafter otherwise provided, all the provisions of the Land Drainage Act, 1908 (hereinafter referred to as the said Act), shall extend and apply to the said district and to the Board thereof as if the district had been constituted by the Governor pursuant to the provisions of the said Act.
3 Constitution of Board.
(1.)
The Board of Trustees of the said district shall consist of four persons, of whom two shall be appointed by the Minister of Lands, and two shall be elected by the ratepayers of the district in the manner prescribed by the said Act.
(2.)
Of the Trustees appointed by the Minister as aforesaid, one shall be appointed as Chairman and the other as Acting-Chairman of the Board.
4 All land within the district to be subject to rates.
(1.)
All rates made and levied by the Board under the authority of the said Act shall be made and levied on the unimproved value of all land within the district, whether the said land is rateable property within the meaning of the Rating Act, 1908, or not.
(2.)
In respect of Crown land of which there is for the time being no occupier within the meaning of the Rating Act, 1908, the Minister of Lands shall be deemed to be the occupier, and all rates payable in respect of such land shall from time to time, be paid out of the Consolidated Fund without further appropriation than this Act:
Provided that the Minister of Lands shall not be deemed to be a ratepayer for the purpose of any election of Trustees under section three hereof.
5 Land not to be subject to Kauri-gum Industry Act.
No part of the land described in the Schedule hereto shall be deemed to be or shall hereafter be declared to be within the boundaries of a kauri-gum district under the Kauri-gum Industry Act, 1908.

ALL that area in the Auckland Land District bounded by a line commencing at the south-eastern corner of Mapere No. 2 Block, in Block IV, Ahipara Survey District; thence along the south-eastern boundaries of Mapere No. 2 and Wairoa No. 2 Blocks to the sea; thence along the seashore to the road at the south-western corner of Section No. 34, Block II, Ahipara Survey District; thence along the southern side of the road forming the southern boundary of that section; thence along the eastern side of the road forming the eastern boundaries of Sections Nos. 34, 36, 38, 41, and 44 to the northernmost corner of Section No. 43; thence along a right line to the south-western corner of Section No. 3, in Block I, Ahipara Survey District; thence along the western boundary of that section and the western boundary of Old Land Claim No. 159 to the north-eastern corner of Section No. 19, Block VIII, Opoe Survey District; thence along a right line to the south-western corner of Old Land Claim No. 6, in Block VIII aforesaid; thence along the western and northern boundaries of the said Old Land Claim No. 6 to the sea; thence along the seashore and the Okapiti, Okuraiti, and Pairatahi Rivers to the north-western boundary of Kareponia Block; thence along the north-western and north-eastern boundaries of that block to the road at the southernmost corner of Section No. 94, Mangatete Parish; thence along the western side of the road intersecting Kareponia Block and forming the western boundaries of Sections Nos. 1, 4, 5, 16, and 17, Awanui Parish, and along the south-western boundary of the last-mentioned section to Oturu No. 1 Block; thence along part of the north-western boundary of that block and along its south-western boundary to its southernmost corner; thence along the southern side of the road forming the south-western boundary of Oturu Block and forming the south-western boundaries of the southern parts of Sections Nos. 7 and 11, and of Sections Nos. 10, 9, and 8, Mangatete Parish, and intersecting Te Konoti Block, to its junction with the road forming the northern boundary of Rangitihi Block; thence along the northern side of that road and the road intersecting Okeremene Block; and along the western side of the road forming the eastern boundaries of Sections Nos. 5, 6, 14, 15, 16, and 17, Block VI, Takahue Survey District, to the south-eastern corner of the last-mentioned section; thence along the southern boundaries of Sections Nos. 17, 18, 19, and 20, Block VI, Takahue Survey District, the southern boundaries of Sections Nos. 9 and 10, Block V, and the south-western boundary of the last-mentioned section to the south-eastern boundary of Ahipara Parish; thence along the south-eastern boundary of that parish to the southernmost corner of Section No. 53; thence along the southern boundary of Old Land Claim No. 8, and along the Matamau and Pukerato Streams to Kaitaia Road; thence along the northwestern side of that road and of the road forming the southern boundary of the northern portion of Section No. 19, Ahipara Parish, to the south-eastern corner of Mapere No. 2 Block, the place of commencement: as the same is delineated on the plan marked L. and S. 11/879A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
