An Act to amend the Wyndham Recreation Reserve Act, 1877.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Wyndham Recreation Reserve Amendment Act, 1923, and shall form part of and be read together with the Wyndham Recreation Reserve Act, 1877 (hereinafter referred to as the principal Act).
2 Wyndham Town Board declared a leasing authority.
With respect to the land described in the Schedule to the principal Act the Wyndham Town Board is hereby declared to be a leasing authority under the Public Bodies’ Leases Act, 1908.
3 Power to grant leases.
Notwithstanding anything contained in the Public Reserves and Domains Act, 1908, or in the principal Act or any other Act, the Wyndham Town Board may, with respect to the said land or any part or parts thereof, exercise all or any of the powers exercisable by a leasing authority under the Public Bodies’ Leases Act, 1908, but so that the said land shall be available and accessible to the inhabitants of the Town of Wyndham and the surrounding district for recreation purposes, subject to the control of the Wyndham Town Board as governing body, as provided for by section twenty-nine of the Public Reserves and Domains Act. 1908.
4 Rents to be expended in improving land.
All rents, issues, and profits arising from the said lands under any tenure whatever shall be expended in improving the said land.
5 Section 5 of principal Act repealed.
Section five of the principal Act is hereby repealed.
