An Act to amend the Auckland University College Reserves Act, 1885.
Preamble.
WHEREAS the lands referred to in the Schedule hereto comprise lands which were vested in the Auckland University College Council by the Auckland University College Reserves Act, 1885, and lands forming portions of closed roads which are not vested in the said Council: And whereas it is considered advisable to vest in the said Council the lands comprised in the said portions of closed roads and to empower the said Council to dispose of the freehold of all the lands referred to in the said Schedule subject to rights in respect of minerals therein being reserved to the said Council:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Auckland University College Reserves Amendment Act, 1928, and shall be read together with and deemed part of the Auckland University College Reserves Act, 1885.
2 Vesting in College Council portions of closed road.
The lands referred to in the Schedule to this Act as being closed roads are hereby vested in the Auckland University College Council to be held by it in trust for the purposes of the Auckland University College.
3 College Council may sell lands described in Schedule hereto.
Notwithstanding anything to the contrary in the Auckland University College Reserves Act, 1885, or in any other Act, the Auckland University College Council may—
(a)
Sell the freehold of the whole or any portion of any of the lands described in the Schedule hereto at such price, in such manner, and upon such terms as the Governor-General in Council approves:
(b)
Accept a surrender of the lease of any such land or portion thereof upon such terms and conditions as the Minister of Education approves:
(c)
Dedicate as a public road any portion or portions of any such land:
Provided that no such land shall be so sold or dedicated as a road without the consent of the lessee or lessees thereof for the time being.
4 Reserving to College Council right to minerals on lands sold by it.
(1)
The sale pursuant to the last preceding section of any of the said lands shall not confer on the purchaser thereof any rights to any minerals within the meaning of the Land Act, 1924; and all such minerals shall remain the property of the College Council, which shall have reserved to it and to all persons authorized by it in that behalf a right at all times of ingress, egress, and regress in respect of all such lands for the purpose of extracting such minerals.
(2)
The College Council may for such consideration on such terms and subject to such conditions as the Minister of Mines may approve grant to any person the right to extract such minerals from such lands.
5 Disposal of proceeds of sale.
All moneys received by the College Council in respect of the sale of any land pursuant to the powers conferred by this Act shall, after deducting therefrom any necessary costs or charges incurred in connection with such sale, be expended in the purchase of other lands or invested in such manner as trust funds may be lawfully invested under the Trustee Act, 1908, and all lands so purchased and all such investments shall be held in trust by the Council for the purposes of the Auckland University College.
Schedule
All that area in the Parish of Taupiri, in the Auckland Land District, being subdivisions of Allotment 463, and being Lot 15, consisting of 100 acres; Lot 16, consisting of 98 acres 3 roods 19 perches; Lot 18, consisting of 88 acres 1 rood perches, and closed road enclosed within Lot 18, consisting of 2 roods 37 perches; Lot 19, consisting of 85 acres and 16 perches, and closed road enclosed within Lot 19, consisting of 3 acres 1 rood 2 perches.
