An Act to amend the War Pensions Act, 1943.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title and commencement.

(1)
This Act may be cited as the War Pensions Amendment Act, 1946, and shall be read together with and deemed part of the War Pensions Act, 1943 (hereinafter referred to as the principal Act).
(2)
This Act shall be deemed to have come into force on the first day of April, nineteen hundred and forty-six.
2 Maximum rates of pensions.
(1)
The principal Act is hereby amended by repealing the First, Second, and Third Schedules, and substituting therefor respectively the First, Second, and Third Schedules to this Act.
(2)
Section eighteen of the principal Act is hereby amended by repealing subsection one, and substituting the following subsection:—
“(1)
Except as otherwise expressly provided in this Act, the rates of pensions payable in respect of the death of a male member of the Forces shall not exceed—
“(a)
To the wife, the appropriate rate specified in the second column of the First Schedule hereto, increased, if she has a child or children actually dependent on her, by a mother’s allowance at the rate specified in the third column of the said Schedule:
“(b)
To each child, the rate specified in the fourth column of the said Schedule:
“(c)
To any other dependant, a weekly rate equal to the average weekly value of the benefits in fact received by the dependant from the member within the period of twelve months immediately preceding the date on which he became a member of the Forces.”
(3)
Section nineteen of the principal Act is hereby amended by repealing subsection one, and substituting the following subsection:—
“(1)
Except as otherwise expressly provided in this Act, the rates of pensions payable in respect of the total disablement of a male member of the Forces shall not exceed—
“(a)
To the member, the appropriate rate specified in the second column of the Third Schedule hereto:
“(b)
To the wife, if she has no child actually dependent on her, the appropriate rate specified in the third column of the said Schedule; or, if she has a child or children actually dependent on her, the appropriate rate for a mother’s allowance specified in the fourth column of the said Schedule:
“(c)
To each child, the rate specified in the fifth column of the said Schedule:
“(d)
To any other dependant, a weekly rate equal to the average weekly value of the benefits in fact received by the dependant from the member within the period of twelve months immediately preceding the date upon which he became a member of the Forces.”
3 Maximum rates of economic pensions.
Section fifty-one of the principal Act is hereby amended as follows:—
(a)
By omitting from paragraph (b) the words “without any child actually dependent on her”

By repealing paragraph (c).
4 Maximum rates of Emergency Reserve Corps pensions.
(1)
Section fifty-six of the principal Act is hereby amended by omitting from paragraph (a) of subsection two the words “and sixpence”
.
(2)
Section fifty-seven of the principal Act is hereby amended by omitting from paragraph (d) the words “and sixpence”
, and also by repealing paragraph (c), and substituting the following paragraph:—
“(c)
To or on account of the wife of a member, if she has no child actually dependent on her, the sum of one pound a week; or, if she has a child or children actually dependent on her, a mother’s allowance at the rate of one pound ten shillings a week:”
5 Pensions in respect of children may be continued at former rate in discretion of Board.
Notwithstanding anything to the contrary in the going provisions of this Act, the Board may, in its discretion, continue any pension payable under the principal Act in respect of any child at the rate at which it was payable on the thirty-first day of March, nineteen hundred and forty-six.
6 Board may terminate pensions in respect of children where family benefit is payable.

Notwithstanding anything to the contrary in the principal Act, the Board, in its discretion, may refuse to grant or may terminate any pension in respect of any child where a family benefit in respect of that child is or may become payable under the Social Security Act, 1938.
7 Refusal or termination of pensions to women in certain cases.
Section seventy-five of the principal Act is hereby amended as follows:—
(a)
By adding to subsection one the words “or, being a woman, is living as the wife of a man to whom she is not married”
