An Act to Empower and Authorize the Invercargill City Council to Amalgamate its Gasworks and Electricity Undertakings and the Separate Accounts Kept in Respect Thereof.
Preamble.
WHEREAS it is desirable to combine the electricity and gas undertakings of the Invercargill City Council and the separate accounts heretofore kept by the Council in respect thereof, and also to authorize the Council to borrow moneys to provide a modern gas-manufacturing plant and improve and extend its manufacturing and distributing system:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title and commencement.
(1)
This Act may be cited as the Invercargill City Gasworks and Electricity Empowering Act, 1948.
(2)
This Act shall come into force on the first day of April, nineteen hundred and forty-nine.
2 Interpretation.
In this Act, unless the context otherwise requires,—
“The Council” means the Invercargill City Council.
3 Combining electricity and gas undertakings.
(1)
The electricity and gas undertakings of the Council are hereby combined to form one light, power, and heat undertaking, which is hereby declared to be a trading undertaking within the meaning and for the purposes of Part XI of the Municipal Corporations Act, 1933.
(2)
The Electricity and Gasworks Accounts heretofore kept by the Council are hereby combined, and shall hereafter be kept as one account to be known as the Light, Power, and Heat Account.
4 Assets and liabilities of undertakings.
All assets and liabilities of the electricity and gas undertakings of the Council shall be assets and liabilities of the light, power, and heat undertaking established by this Act.
5 Combined accounts to consumers.
The Council is authorized and empowered to render one combined account to any consumer for gas and electricity consumed during the period for which a charge is made.
