An Act to amend the Onehunga Borough Vesting Act 1911
WHEREAS as part of its main drainage scheme the Auckland Metropolitan Drainage Board requires to lay and maintain a branch sewer over portion of the land vested in the Mayor, Councillors, and Citizens of the Borough of Onehunga by the Onehunga Borough Vesting Act 1911 (hereinafter referred to as the principal Act): And whereas under section four of the principal Act it is provided that in the event of that portion of the said land firstly described in the Schedule to the principal Act being reclaimed from the sea there shall be left a waterway as therein set forth: And whereas the need for the reservation of any such waterway no longer exists:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Onehunga Borough Vesting Amendment Act 1957.
2 Section 4 of principal Act repealed
Section four of the principal Act is hereby repealed.
3 Rights granted to Drainage Board
The Auckland Metropolitan Drainage Board may lay a sewer across the land firstly described in the Schedule to the principal Act in the position approximately shown upon a plan lodged in the Office of the Chief Surveyor at Auckland under No. 40337, and described in the Schedule hereto, and for such purpose may construct and maintain at all times hereafter an embankment (with any necessary culverts) or other supports or protective works, with such right of entry upon the said land at all times with plant and machinery as may be necessary for the purpose of constructing, inspecting, and maintaining such sewer and other work as aforesaid.
Schedule
A line commencing at a point on the western side of Lot 1 on D.P. 25356, 155·35 links southward from the north-west corner of the said Lot 1, and extending thence in an east-north-easterly direction for a distance of 433·68 links to intersect the northern boundary of the said Lot 1 at a distance of 405·43 links eastward from its north-western corner.
