An Act to amend the Quarries Act 1944
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Quarries Amendment Act 1961, and shall be read together with and deemed part of the Quarries Act 1944 (hereinafter referred to as the principal Act).
2 Recognition of certificates granted outside New Zealand
The principal Act is hereby amended by inserting, after section 13, the following section:
“13A.
Notwithstanding anything in subsection (1) or subsection (2) of section 13 of this Act, the Inspector may grant a quarry manager’s surface certificate or a tunnel manager’s certificate without examination to an applicant resident in New Zealand, whether permanently or temporarily, where—
“(a)
In the opinion of the Board of Examiners established by regulations made under this Act,—
“(i)
The applicant is the holder of a certificate of corresponding class granted outside New Zealand, or his credentials clearly demonstrate his experience outside New Zealand as a surface-quarry manager or a tunnel manager, as the case may be, and his ability to carry out his duties as such; and
“(ii)
The standard of training and examination required for the grant of any such certificate held by the applicant is equivalent to that required for the grant of a corresponding certificate under this Act; and
“(b)
The Inspector is satisfied that—
“(i)
The applicant is of good character and repute; and
“(ii)
The applicant is able to speak, write, and understand the English language sufficiently for the purpose of carrying out any duties authorised by the certificate applied for:
“Provided that before granting a certificate under this section the Inspector shall satisfy himself, by examining the applicant orally, that he has an adequate knowledge of the law in force in New Zealand relating to quarries or tunnels, as the case may be, and to quarrying or tunnelling methods in New Zealand.”
This Act is administered in the Mines Department.
