An Act to amend the Animals Protection Act 1960
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Animals Protection Amendment Act 1962, and shall be read together with and deemed part of the Animals Protection Act 1960 (hereinafter referred to as the principal Act).
2 Destruction of injured or suffering animals
(1)
Section 12 of the principal Act is hereby amended by omitting from paragraph (a) of subsection (3) and also from paragraph (b) of that subsection the words “and shall”
, and substituting in each case the words “and may, if it is convenient for him to do so”
.
(2)
Section 12 of the principal Act is hereby further amended by inserting, after subsection (3), the following subsection:
“(3a)
Where, pursuant to subsection (3) of this section, an Inspector destroys any animal or causes it to be destroyed and cannot conveniently dispose of the carcass, he shall forthwith report its destruction to the local authority in whose district the animal was destroyed, and the local authority shall thereupon take immediate steps to dispose of the carcass in any manner it thinks fit.”
3 Expenses incurred by local authority
Section 13 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1a)
All expenses reasonably incurred by any local authority in disposing of the carcass of any animal pursuant to subsection (3a) of section 12 of this Act shall be recoverable from the owner or person in charge or appearing to be in charge of the animal.”
