An Act to amend the Harbours Act 1950
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Harbours Amendment Act 1963, and shall be read together with and deemed part of the Harbours Act 1950 (hereinafter referred to as the principal Act).
2 Secretary to preside at meeting of Board for election of Chairman
(1)
Section 35 of the principal Act is hereby amended by repealing subsection (3), and substituting the following subsection:
“(3)
At every meeting for the election of Chairman the Secretary shall preside, and in the event of there being an equality of votes of members at that election the matter shall be decided by lot as between the members having that equality of votes.”
(2)
Notwithstanding anything in the principal Act or in any other Act or rule of law, no election or appointment of any persons to the office of Chairman or Deputy Chairman heretofore made shall be deemed to have been invalid by reason of the fact that the Secretary of the Board acted as Chairman for the whole or part of the meeting at which those persons were elected or appointed.
3 Board may create a special fund for repayment of loans
Section 60 of the principal Act is hereby amended by adding to paragraph (f) of subsection (1) the words “or the repayment of any loan or loans or any part thereof”
.
