An Act to amend the Trading Coupons Act 1931
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Trading Coupons Amendment Act 1969, and shall be read together with and deemed part of the Trading Coupons Act 1931 (hereinafter referred to as the principal Act).
2 Interpretation
The definition of the term “trading coupon”
in section 2 of the principal Act is hereby amended by inserting, after the words “act or thing”
, the words “and whether or not it has to be produced or surrendered to any person”
.
3 Trading coupon companies, etc.
The principal Act is hereby amended by inserting, after section 4, the following section:
“4a
Every company, firm, or other person commits an offence against this Act and is liable on summary conviction to a fine not exceeding one thousand dollars, and in the case of a continuing offence to a further fine not exceeding one hundred dollars for every day during which the offence continues, if the company, firm, or other person supplies or arranges for the supply of any coupon, stamp, token, cover, package, document, or other thing either directly or indirectly to any manufacturer, packer, importer, distributor, or seller of any goods and undertakes to redeem the coupon, stamp, token, package, document, or other thing, or that it will be redeemed, whether or not it has to be produced or surrendered to any person, by giving or delivering to the holder thereof any money, goods, or service:
“Provided that nothing in this section shall apply to any coupon, stamp, token, cover, package, document, or thing issued directly or indirectly in connection with any goods by the manufacturer, packer, importer, distributor, or seller of the goods, being a coupon, token, cover, package, document, or thing which by itself or with any other act or thing entitles or purports to entitle the holder thereof to receive any money from the issuer, whether or not it has to be produced or surrendered to any person.”
4 Offences
(1)
Section 5 of the principal Act is hereby amended by omitting the words “the last preceding section”
, and substituting the words “section 4 of this Act”
.
(2)
Section 5 of the principal Act is hereby further amended by adding, as subsection (2), the following subsection:
“(2)
Every person is guilty of an offence against this Act who gives any discount or makes any other gift, allowance, concession, or benefit of any kind whatsoever in respect of any act or thing which depends upon or is in any way connected with any information in any trading coupon the redemption of which would be an offence under the foregoing provisions of this section.”
5 Penalty for Offences
Section 6 of the principal Act is hereby amended by inserting, after the words “offence against this Act”
, the words “for which no penalty is provided elsewhere than in this section”
.
