Analysis
An Act to amend the Domestic Proceedings Act 1968
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Domestic Proceedings Amendment Act 1970, and shall be read together with and deemed part of the Domestic Proceedings Act 1968 (hereinafter referred to as the principal Act).
2 Effect of registration or confirmation of Commonwealth order
Section 67 of the principal Act is hereby amended as from the commencement of that Act by omitting from subsection (1) the words “section 64”
, and substituting the words “section 65”
.
3 Registration of foreign orders
(1)
Section 72 of the principal Act is hereby amended—
(a)
By repealing subsection (1):
(b)
By inserting in subsection (2), after the words “maintenance orders”
, the words “or maintenance orders of any specified kind”
.
(2)
Section 72 of the principal Act is hereby further amended by adding to paragraph (b) of subsection (5) the word “or”
and by adding to that subsection the following paragraph:
“(c)
That, in the case of an order made in or consequent upon an affiliation order, the defendant neither appeared in the proceedings in which the affiliation order was made nor was duly served with a summons to appear in those proceedings.”
