An Act to amend the Protection of Depositors Act 1968
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Protection of Depositors Amendment Act 1972, and shall be read together with and deemed part of the Protection of Depositors Act 1968 (hereinafter referred to as the principal Act).
2 Interpretation
Section 2 of the principal Act is hereby amended by adding, as subsections (2) and (3), the following subsections:
“(2)
Any reference in this Act to an invitation to the public to deposit money with any person shall be construed as including a reference to an invitation to any section of the public, whether selected as clients of the person issuing the invitation or causing it to be issued or in any other manner.
“(3)
Subsection (2) of this section shall not be taken as requiring an invitation to be treated as being to the public if it can properly be regarded, in all the circumstances, as not being calculated to result directly or indirectly in the deposit, with the person issuing the invitation or causing it to be issued, of any money by persons other than those receiving the invitation, or otherwise as being a domestic concern of the person issuing the invitation or causing it to be issued and the persons receiving it.”
3 Time limit for laying informations
The principal Act is hereby further amended by inserting, after section 9, the following section:
“9A
An information in respect of an offence against this Act may be laid at any time within 3 years after the time when the matter of the information arose.”
