An Act to amend the Pharmacy Act 1970
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Pharmacy Amendment Act 1977, and shall be read together with and deemed part of the Pharmacy Act 1970 (hereinafter referred to as the principal Act).
2 Appeals from decisions of Council
Section 51 of the principal Act is hereby amended by repealing subsection (2), and substituting the following subsections:
“(2)
On receipt of the notice of appeal, the Registrar shall forthwith inform the Minister, who shall thereupon take all steps necessary for the constitution of a Board of Appeal consisting of—
“(a)
A Magistrate or barrister appointed by the Minister; and
“(b)
Two assessors who shall be pharmacists to be appointed, in accordance with regulations made under this Act, to represent respectively the Council and the appellant.
“(2a)
An appeal under this section shall lapse if, before the appeal is determined, the appellant withdraws his appeal.”
