An Act to validate the registration of certain persons as podiatrists
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Medical Auxiliaries (Podiatrists) Amendment Act 1997, and is part of the Medical Auxiliaries Act 1966.
(2)
This Act comes into force on the day after the date on which it receives the Royal assent.
2 Interpretation
In this Act, unless the context otherwise requires,—
“Board” means the Podiatrists Board continued under the Regulations:
“Register” means the Register of Podiatrists kept under section 19 of the Medical Auxiliaries Act 1966:
“Regulations” means the Podiatrists Regulations 1982 (S.R. 1982/53):
“Relevant period” means the period beginning on 1 April 1984 and ending with the close of 21 February 1992.
3 Validation of registration of certain podiatrists
(1)
Every person whose name was entered in the Register, on a date in the relevant period and in the circumstances described in subsection (2), is to be taken—
(a)
To have been validly registered on that date as a podiatrist; and
(b)
To have been entitled to be so registered.
(2)
The circumstances referred to in subsection (1) are that—
(a)
The Board directed that the person be registered on the basis of the person’s overseas qualification in podiatry, even though (contrary to the Regulations) the person had not passed an examination conducted by or on behalf of the Board in the theory and practice of podiatry, and, accordingly, was not qualified to be registered; and
(b)
The person was in all other respects entitled to be registered as a podiatrist.
4 Protection from actions
(1)
Any issue relating to or arising out of anything done or omitted by a person referred to in subsection (1) of section 3 since the date on which that person is to be taken to have been registered as a podiatrist must be determined having regard to that subsection.
(2)
A proceeding that—
(a)
Concerns any matter relating to or arising out of the entry in the Register, on a date in the relevant period, of the name of a person referred to in section 3(1); and
(b)
Is commenced on or after 25 September 1997—
must be determined having regard to section 3(1).
