An Act to amend the Matrimonial Property Act 1976
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Matrimonial Property Amendment Act 1998, and is part of the Matrimonial Property Act 1976 (“the principal Act”
).
2 Regard for interests of children
Section 26(3) of the principal Act (as inserted by section 3 of the Matrimonial Property Amendment Act 1994) is amended by repealing paragraph (b) (as amended by section 10(1) of the Department of Justice (Restructuring) Act 1995), and substituting the following paragraph:
“(b)
Are payable by such party or parties to the proceedings as the Court orders or, if the Court so decides, are payable out of public money appropriated by Parliament for the purpose.”
3 Inquiries, and settlement of schemes
Section 38(4) of the principal Act (as substituted by section 4 of the Matrimonial Property Amendment Act 1994) is amended by repealing paragraph (b) (as amended by section 10(1) of the Department of Justice (Restructuring) Act 1995), and substituting the following paragraph:
“(b)
Are payable out of public money appropriated by Parliament for the purpose.”
4 Consequential amendment
The Department of Justice (Restructuring) Act 1995 is consequentially amended by omitting the item in the First Schedule relating to sections 26 and 38 of the Matrimonial Property Act 1976.
