Pursuant to section 61 of the Health Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
Order
1 Title and commencement
(1)
This order may be cited as the Kakapo Stream Pollution Control Order 1976.
(2)
This order shall come into force on the day after the date of its notification in the Gazette.
2 Control of Kakapo Stream
All those portions of the Kakapo Stream and its tributaries that are within the boundaries of the land described in the Schedule are hereby declared to be under the control of the Clifton County Council for the purpose of preventing their pollution.
Schedule
All that land in the County of Clifton containing 256 ha approximately being more particularly delineated on a plan held in the Head Office of the Department of Health at Wellington, entitled Urenui Township Water Supply (Kakapo Stream) Pollution Control Area, and numbered 124/9/16 (being a copy of a Survey Office Plan 10589).

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order places portions of the Kakapo Stream and its tributaries under the control of the Clifton County Council for the purpose of preventing pollution. The portions concerned are those within an area of 256 ha extending from its source to the Urenui Township water supply intake.

1 General
This is a consolidation of the Kakapo Stream Pollution Control Order 1976 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
