    At Wellington this 17th day of July 2006

Pursuant to section 37 of the Misuse of Drugs Act 1975, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title

  • These regulations are the Misuse of Drugs (Fees) Amendment Regulations 2006.

2 Commencement

  • These regulations come into force on 21 August 2006.

3 Principal regulations amended
4 Applications for and issue of licences

  • Regulation 3(4) is amended by omitting “a licence fee of $10” and substituting “the appropriate licence fee set out in Schedule 1AA”.

5 New regulation 3A inserted

  • The following regulation is inserted after regulation 3:

    “3A Fees inclusive of GST

    • The fees fixed by these regulations are inclusive of goods and services tax under the Goods and Services Tax Act 1985.”

6 Duration and renewal of dealers' licences

  • Regulation 6(4) is amended by omitting “a licence fee of $10” and substituting “the appropriate licence fee set out in Schedule 1AA”.

7 New Schedule 1AA inserted

  • The Schedule 1AA set out in the Schedule of these regulations is inserted before Schedule 1A.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 21 August 2006, amend the licence fee prescribed in regulations 3(4) and 6(4) of the Misuse of Drugs Regulations 1977. The new fees reflect the different types of licences issued under the Misuse of Drugs Act 1975 and are for—

  • •a licence to deal in controlled drugs, $945:

  • •a licence to import controlled drugs, $190:

  • •a licence to export controlled drugs, $190:

  • •a licence to possess controlled drugs, $945.
