These regulations are made under section 37 of the Misuse of Drugs Act 1975 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Misuse of Drugs Amendment Regulations (No 2) 2016.
2 Commencement
(1)
Regulation 5 comes into force on 19 September 2016.
(2)
The rest of these regulations come into force on 20 September 2016.
3 Principal regulations
These regulations amend the Misuse of Drugs Regulations 1977 (the principal regulations).
4 Schedule 1A replaced
Replace Schedule 1A with the Schedule 1A set out in the Schedule of these regulations.
5 Consequential amendments
(1)
This regulation amends the Misuse of Drugs Amendment Regulations 2016.
(2)
Revoke regulation 6 and the Schedule.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which mainly come into force on 20 September 2016, amend the Misuse of Drugs Regulations 1977.
The amendments replace Schedule 1A, which lists the controlled drugs that designated prescriber nurses may prescribe in certain circumstances.
The Misuse of Drugs Amendment Regulations 2016 included an amendment to replace Schedule 1A on 20 September 2016. The list of controlled drugs in those amendment regulations incorrectly included Zopiclone. The effect of these regulations is to replace the list so that it no longer includes Zopiclone. Zopiclone is not a controlled drug but a prescription medicine and should instead be on the list of specified prescription medicines that designated nurse prescribers may prescribe.
