Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
These regulations are the Fisheries (Challenger Area Commercial Fishing) Amendment Regulations 2009.
2 Commencement
These regulations come into force on 1 June 2009.
3 Principal regulations amended
These regulations amend the Fisheries (Challenger Area Commercial Fishing) Regulations 1986.
4 Set net fishing prohibited in certain areas from Clarence Point to Cape Jackson
Regulation 2BC(2) is amended by—
(a) omitting
“a harbour entrance or, as the case may be,”
; and
(b) omitting
“harbours and”
.
5 Trawling prohibited in certain areas from Clarence Point to Cape Jackson
Regulation 4(2) is amended by—
(a) omitting
“a harbour entrance or, as the case may be,”
; and
(b) omitting
“harbours and”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 June 2009, amend regulations 2BC(2) and 4(2) of the Fisheries (Challenger Area Commercial Fishing) Regulations 1986, which prohibit set netting and trawling in a certain area from Clarence Point to Cape Jackson, to omit the references to harbours.
