Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations 2014.
2 Commencement
These regulations come into force on 2 March 2014.
3 Principal regulations
These regulations amend the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986 (the principal regulations).
4 New regulation 15AA and cross-heading inserted
After regulation 15, insert:
“Bounty Islands and Campbell Island prohibitions
“15AA Fishing with Danish seine net prohibited in specified areas
-
“(1) A commercial fisher must not use a Danish seine net for taking fish within the waters of a prohibited area specified by this regulation.
“(2) The first prohibited area is any part of the territorial sea around the Bounty Islands that excludes Section 1 on Survey Office plan SO 442748, meaning that the first prohibited area is any part of that territorial sea that is—
“(a) west of longitude 178°54.23′E; or
“(b) both south of latitude 47°43.73′S and east of longitude 179°09.14′E.
“(3) The second prohibited area is Section 2 on Survey Office plan SO 442749, meaning that the second prohibited area is any part of the territorial sea around Campbell Island (and adjacent islands shown on that plan) that is 1 or more of the following:
“(a) north of latitude 52°24.48′S:
“(b) east of longitude 169°20.28′E:
“(c) south of latitude 52°39.48′S.”

5 Regulation 16 amended (Offences)
In regulation 16(2), after

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986. They come into force on 2 March 2014.
The amendments prohibit a commercial fisher from using a Danish seine net for taking fish within the waters of specified areas around the Bounty Islands and Campbell Island. A breach of the prohibition is an offence with a maximum fine of $100,000.
