Pursuant to sections 28B and 28C of the Fisheries Act 1983, the Minister of Fisheries, acting after consultation with the Fishing Industry Board in the case of section 28B, and after allowing for the matters specified in section 28C, hereby gives the following notice.

1 Title and commencement
(1)
This notice may be cited as the Fisheries (Quota Management Areas, Total Allowable Catches, and Catch Histories) Notice 1986.
(2)
This notice shall come into force on 1 October 1986.
2 Interpretation
In this notice, unless the context otherwise requires, all references to named fishery management areas are references to those areas as defined in a notice published in the Gazette of 1986 at page 412.
3 Quota management areas
(1)
The taking of the species or classes of fish specified in Schedule 1 is hereby declared to be subject to the quota management system established under Part 2A of the Fisheries Act 1983 on and from 1 October 1986 in the quota management areas specified in that schedule.
(2)
The quota management areas (other than paua quota management areas) referred to by name and reference number in Schedule 1 are the fishery management areas having the same reference number and described in Schedule 1 of the Fisheries Act 1996.
(2A)
The quota management areas for paua referred to by name and reference number in Schedule 1 are the quota management areas for paua having the same reference number and described in Part 3 of Schedule 1 of the Fisheries Act 1996.

The quota management areas referred to by name and reference number in Schedule 1 in relation to long-finned freshwater eel and short-finned freshwater eel are the quota management areas described in Part 3 of Schedule 1 of the Fisheries Act 1996 .
(3)
Where 2 or more quota management areas are shown as combined in Schedule 1 in respect of any species or class of fish the combined areas shall together comprise 1 quota management area for that species or class of fish.

4 Total allowable catches

5 Periods to be used to determine provisional maximum individual transferable quotas
(1)
The periods for which fishing returns are to be used under section 28E(1) of the Fisheries Act 1983 in determining provisional maximum individual transferable quotas for paua shall be the calendar years 1982 and 1983.
(2)
The periods for which fishing returns are to be used under section 28E(1) of the Fisheries Act 1983 in determining provisional maximum individual transferable quotas for species or classes of fish other than paua shall be—
(a)
where 50% or more of the fish taken by the commercial fisherman was 1 or more of the species or classes of fish specified in Schedule 3, the fishing year that commenced with 1 October 1983:
(b)
in any other case, any 2 of the fishing years that commenced with 1 October 1981, 1 October 1982, or 1 October 1983, as chosen by the commercial fisherman.
