Pursuant to section 229 of the Sale of Liquor Act 1989, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the Sale of Liquor Amendment Regulations 2013.
2 Commencement
These regulations come into force on the day after the date of their notification in the Gazette.
3 Principal regulations
These regulations amend the Sale of Liquor Regulations 1990 (the principal regulations).
4 Regulation 21AA replaced (General managers’ prescribed qualification)
Replace regulation 21AA with:
21AA General managers’ prescribed qualification

The Licence Controller Qualification is a qualification for the purposes of section 117A of the Act.

In this regulation and in regulation 21AAB, Licence Controller Qualification means the qualification relating to the management of licensed premises that is issued by an industry training organisation that is recognised, under the Industry Training Act 1992, in respect of an industry that involves the sale and supply of liquor on licensed premises.
5 Regulation 21AAB amended (Criteria to obtain Licence Controller Qualification)
In regulation 21AAB(1), replace “Institute”
with “relevant industry training organisation”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Sale of Liquor Regulations 1990 (the principal regulations).
The qualification prescribed by the principal regulations for the issue or renewal of a general manager’s certificate is the Licence Controller Qualification awarded by the Hospitality Standards Institute. As the Hospitality Standards Institute has merged with a new organisation, called the Service Skills Institute, the principal regulations need to be updated. Accordingly, these regulations amend the principal regulations to require the requisite qualification to be issued by the relevant industry training organisation.
