These regulations are administered by the Ministry of Business, Innovation, and Employment.
Pursuant to section 21 of the Health and Safety in Employment Act 1992, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Labour made after consultation in accordance with section 21(2) of that Act, makes the following regulations.
Regulations
1 Title
These regulations are the Health and Safety in Employment (Mining Administration) Amendment Regulations 2010.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations amended
These regulations amend the Health and Safety in Employment (Mining Administration) Regulations 1996.
4 Certificate of competence of manager of underground coal mine

Regulation 11(1) is amended by omitting “subclauses (2) and (3)”
and substituting “subclause (2)”
.

Regulation 11(2) is amended by omitting “more than 8 people but”
.
(3)
Regulation 11(3) is revoked.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend regulation 11 of the Health and Safety in Employment (Mining Administration) Regulations 1996.
Regulation 11 provides for managers of underground coal mines to hold certain certificates of competence. The amendments remove references to a certificate of competence as a coal mine deputy. This means that a manager of an operation in which an underground coal mine is worked by not more than 15 people underground at any one time must hold either a certificate of competence as a first-class coal mine manager or a certificate of competence as a coal mine underviewer.

1 General
This is a consolidation of the Health and Safety in Employment (Mining Administration) Amendment Regulations 2010 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
