Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 23 June 2017, amend the Electoral Regulations 1996 (the principal regulations).

Regulation 37 is amended to remove references to declarations being “endorsed”. This amendment is consequential to a recommendation made in the Justice and Electoral Committee’s Report on the Inquiry into the 2014 general election (the report) that the principal regulations be amended to facilitate a fully electronic process for special vote declaration processing.

The principal regulations are also amended to extend the application of special voting under Part 4 to voters on vessels not scheduled to return to port during the polling period, voters on offshore installations, and voters on remote islands administered by the Department of Conservation. These amendments give effect to changes recommended in the report.

Regulations 57 and 58 are amended to give effect to a recommendation made in the report that special voters be able to request dictation voting until 4 pm on the Thursday before polling day, and that the deadline for casting a vote by dictation be 7 pm on polling day.
