Electoral Amendment Regulations 2007

Preamble
At Wellington this 27th day of August 2007
Pursuant to section 267 of the Electoral Act 1993, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
These regulations are the Electoral Amendment Regulations 2007.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations amended
These regulations amend the Electoral Regulations 1996.
4 Declaration by special voter
Regulation 25(3) is amended by inserting the following paragraph after paragraph (e):
“(ea) a notary public; or”.
5 Returning Officer to extract declaration form
Regulation 32 is amended by revoking subclause (2) and substituting the following subclause:
“(2) The Returning Officer must ensure that the declaration form and its envelope are marked with the same unique number.”
6 New forms substituted in Schedule 1
Schedule 1 is amended by revoking forms 16, 17, 18, and 21 and substituting the forms 16, 17, 18, and 21 set out in the Schedule of these regulations.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which amend the Electoral Regulations 1996 (the principal regulations), come into force on the 28th day after the date of their notification in the Gazette.
Regulation 4 amends regulation 25(3) of the principal regulations to clarify that notaries public may witness declarations in forms 20 (declaration by member of Defence Force applying to vote as a special voter) and 21 (declaration by special voter who is overseas or on a fishing vessel).
Regulation 5 makes a minor amendment to the processing of special votes by the Returning Officer for the district in which the votes were issued. Regulation 32(2) of the principal regulations currently requires the Returning Officer to consecutively number the declaration form and its envelope. That requirement is replaced with a new requirement that the Returning Officer ensure that the declaration form and its envelope are marked with the same unique number.
Regulation 6 revokes and substitutes the following fauns in Schedule 1 of the principal regulations:
•form 16 (declaration by voter before polling day where the voter is on the printed roll for that electorate):
•form 17 (declaration by special voter where the voter is present at an issuing office or polling place or by a tangata whenua voter):
•form 18 (declaration by special voter where the voter is not present at an issuing office or polling place):
•form 21 (declaration by special voter who is overseas or on a fishing vessel).
The principal change made by the new forms is that the requirement relating to the voter's electorate information precedes the requirement relating to the grounds for special vote that apply to the voter.
