Pursuant to section 28B of the Fisheries Act 1983, the Minister for Food, Fibre, Biosecurity and Border Control gives the following notice.

Notice
1 Title and commencement
-
(1) This notice may be cited as the Fisheries (Declaration of New Stock Subject to Quota Management System) Amendment Notice (No 3) 1999, and is part of the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 (SR 1997/279) (
“the principal notice”
).(2) This notice comes into force on the day after the date of its notification in the Gazette.
2 Interpretation
-
Clause 2 of the principal notice is amended by adding the following paragraph:

“(e) Despite anything in paragraph (d),
‘CDL’
means cardinal fish with the species name Epigonus telescopus.”

3 Cardinal fish in areas 1 and 9 to become subject to quota management system

(1) Clause 3(1) of the principal notice is amended by omitting the expression
“subclauses (2) and (3)”
, and substituting the expression“subclauses (2) to (4)”
.(2) Clause 3 of the principal notice is amended by adding the following subclause:

“(4) Cardinal fish (CDL) is subject to the quota management system established under Part 2A of the Fisheries Act 1983 on and from 1 October 1999 in quota management areas 1 and 9.”

4 Schedule amended

The Schedule of the principal notice is amended by inserting, in their appropriate numerical order in the entries set out in columns 2 and 3 relating cardinal fish, the following entries:

5 Revocation

Clause 2(1) of the Fisheries (Declaration of New Stock Subject to Quota Management System) Amendment Notice 1998 is consequentially revoked.

Explanatory note
This note is not part of the notice, but its intended to indicate its general effect.
This notice, which comes into force on the day after the date of its notification in the Gazette, amends the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 by adding cardinal fish in Fishery Management Area 1 (Auckland East) and Fishery Management Area 9 (Auckland West) to the list of species subject to the quota management system established under Part 2A of the Fisheries Act 1983. Cardinal fish in those areas become subject to the quota management system under that Act on and from 1 October 1999.
The notice also defines the species name of cardinal fish for the purposes of the notice.
